(PIN 25-32-25-23- <br /> 0006) <br /> <br />The Mayor: and Council reviewed the findings of fact presented by Ms. Frolik and requested the <br />following ~endments: Add a finding to read "That on January 6, 1992, a letter was sent to Mr. <br />Gerald Ro0t~ad~ising him of this public heating; no response fi.om Mr. Root. Add a finding to <br />read "GerM~ R~ot was not pre, sent at the public hearing; Stanley (Butch) Browning appeared <br />stating he v~ Mr. Gerald Root s representative. <br /> <br />Motion by C~unl:~ ilmember Peterson and seconded by Councilmember Beyer to adopt Resolution <br />#92-01-018~lo~ng F~nd~ngs of Fact ~}305, as amended, to revoke the con&tlonal use permit for <br />auto sales/ri~lJair~ssued to 14600 Nowthen Boulevard N.W. <br />Further dis0u~sion: Councilmember Zimmerman felt that Mr. Browning is a victim of Mr. Gerald <br />Root not m~g?~the conditions of the permit known to him. Upon inquiry by Mr. Browning, City <br />Attorney G~6drich stated the City has now conducted a public heating. City Staff has proposed a <br />findings offer §.~ased on the record of the happenings at the property and Council is now about to <br />vote on whittier ~ continue or revoke the conditional use permit. Mr. Fred Dinnetz, a co-leasee of <br />the propert~ Witli Mr. Browning, stated he is more than willing to make site improvements to the <br />propertY. C. 4un~il's reply to Mr. Dinnetz was that it appears the conditional use permit will be <br />revoked and Mr. ~Root will be given 90 days to vacate the use from the property; however, another <br />option to th~pro~erty owner is to apply for a new conditional use permit for auto repair only. If <br />that is the ittt~nti~n of the property owner and the leasees, then they should plan to resolve the new <br />CUP by thei:e~ d ~f April 1992 and in the interim begin to make improvements to the condition of <br />the premisOS; Council noted that application for a new CUP does not necessarily mean that it <br />would be aPProv&l; however, the City is willing to work with the leasees. <br /> <br />Motion carfi~' ~e~:l.
