<br />12. That there is an existing ground sign on site that advertises the daily price of gasoline. <br /> <br />13. That the existing ground sign eliminates the ability of other tenants and/or future tenants to utilize a <br />ground sign to promote their businesses. <br /> <br />14. That the Applicant is proposing to install one additional pylon, ground sign that would be 283.3 <br />square feet in area per face, and 35 feet in height. <br /> <br />15. That proposed sign location is within a drainage and utility easement held by the City and within a <br />Connexus Energy easement as well. <br /> <br />16. That the Applicant will be required to submit a written agreement that specifies that it will be the <br />responsibility of the Applicant, or its successors or assigns, to relocate the sign if necessitated by <br />authorized work within the easement, through an easement encroachment agreement. <br /> <br />17. That the City has in the past approved requests for greater square footage than allowed by City Code, <br />but not for an increase in height. <br /> <br />18. That the maximum height was 35 feet until 1994, and that some of the signs on Highway 10 are 35 <br />feet in height. <br /> <br />19. That a conditional use permit to exceed sign size and height restrictions on a single parcel will/will <br />not grant the Applicant special privileges that are denied to other properties in the commercial area. <br /> <br />20. That the proposed increase in sign surface area and height will/will not be designed so as to be <br />harmonious and appropriate in appearance with the existing or intended character of the vicinity and <br />will/will not change the essential character of the area. <br /> <br />21. That the proposed increase in sign surface area and height will/will not adversely impact traffic in <br />the area. <br /> <br />22. That the proposed increase in sign surface area and height will/will not be unduly dangerous or <br />otherwise detrimental to persons residing or working in the vicinity of the use or to the public <br />welfare. <br /> <br />23. That the proposed increase in sign surface area and height will/will not substantially impair the use, <br />enjoyment, or market value of any surrounding property. <br /> <br />24. That the proposed increase in sign surface area and height will/will not be hazardous or disturbing to <br />existing or future neighboring uses. <br /> <br />25.
