<br />Board Member Levine introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #08-04-062 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0824 RELATING TO A <br />REQUEST FOR A VARIANCE FROM LOT WIDTH REQUIREMENTS IN THE <br />CRITICAL RIVER OVERLAY DISTRICT <br /> <br />WHEREAS, Tim Holm, hereinafter referred to as "Applicant", has properly applied for a <br />Board of Adjustment variance to the lot width requirement established in Section 9.20.11 (R-l <br />Residential District) of the Ramsey City Code on the property generally located on the east side <br />of Ebony Street NW, south of Riverdale DriveNW and legally described as follows: <br /> <br />Lot 1, Block 1, Riverview Bowl <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.07 of the Ramsey City Code on April 3, 2008, and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br /> <br />2. That Section 9.21.07 (Critical River Overlay District Standards), establishes a ninety (90) <br />foot minimum lot width requirement for residential districts within the Metropolitan Urban <br />Services Area (MUSA). <br /> <br />3. That the Subject Property has applied for minor sketch plan approval as Ebony Woods on <br />March 10, 2008 and consists of three (3) single-family residential lots served by municipal <br />sewer and water. <br /> <br />4. That the property was previously zoned B-2 Business and the lot width was compliant with <br />Critical River Overlay District standards. <br /> <br />5. That the Applicant's most recent proposals for a multi-family residential Planned Unit <br />Development complied with the Critical River Overlay District standards. <br /> <br />6. That the City Council denied the Applicant's proposals for multi-family development and <br />reached a conclusion that single family development would me more compatible with the <br />surrounding area and rezoned the property to R-l Residential. <br /> <br />7. That the Critical River Overlay District requires 270 feet of road frontage to meet the 90 foot <br />lot width requirement for the three (3) lots proposed. <br />
