<br />The Commission tabled this item to review Case #3. <br /> <br />Case #3: <br /> <br />Request for a Sketch Plan Approval of Kings Ranch Estates North of Nathan <br />Wattenhofer <br /> <br />Assistant Community Development Director Frolik stated Nathan Wattenhofer is requesting <br />sketch plan approval to subdivide a ten (10) acre parcel into two lots. The property is located at <br />17151 Baugh StreetNW. <br /> <br />The plat is a minor subdivision and is not subject to a public hearing. Information regarding the <br />sketch plan request was sent to residents within 350 feet of the subject property. <br /> <br />Assistant Community Development Director Frolik stated Mr. Wattenhofer recently purchased a <br />ten (10) acre parcel that has a single family home and several accessory buildings, the largest of <br />which required a conditional use permit (granted in 2007). In February, a fire damaged a <br />significant portion of one of the smaller accessory buildings and during the subsequent <br />investigation, it was discovered that the large pole building (approximately 15,000 sq. ft.), which <br />was purported to be an indoor riding arena, contained another dwelling unit and appeared to be <br />set up for a commercial operation. City Code does not permit two dwelling units on a single <br />parcel and thus, Staff requested a meeting with Mr. Wattenhofer to discuss potential corrective <br />actions. After meeting with Building, Fire and Planning Staff, Mr. Wattenhofer has applied for a <br />lot split in an attempt to correct the nonconformity. <br /> <br />The minimum lot size in the Rural Developing district is 2.5 acres and minimum lot width is 200 <br />feet. The lot split would result in one 3 acre parcel and one 7 acre parcel with lot widths of 380 <br />feet and 278 feet in width respectively. Each lot will be served by individual wells and septic <br />systems, which currently exist; however, the septic system on Lot 2 will need to be replaced or <br />upgraded to account for the dwelling unit. <br /> <br />The sketch plan also identifies the location of existing structures and indicates that they comply <br />with both principal and accessory structure property line setbacks. However, there is existing <br />pavement and fencing that span the proposed new lot line. The development agreement will <br />address these issues by requiring cross access easements where shared use of the pavement exists <br />or, in the event either lot is sold to another party, these encroachments be corrected and brought <br />into compliance with current regulations. The proposed lot split does not require any new roads <br />and access to both lots will be gained from Baugh St. <br /> <br />The plat will be reviewed for park dedication and trail requirements by the Park Commission at <br />their April meeting. <br /> <br />Commissioner Van Scoy asked if this pole building would be considered a primary structure. <br /> <br />Assistant Community Development Director Frolik stated it would essentially be a home with an <br />attached garage. <br /> <br />Planning Commission / April 3, 2008 <br />Page 6 of 21 <br />
