Case #5: Change Order No. 1 and Final Pay Estimate for Project #90-30 ParaBody Landscaping Improvements. City Engineer Jankowski summarized Improvement Project g90-30 which included landscaping improvemants tO the ParaBody site located on Sunfish Lake Boulevard N.W. This project was initiated un~r Tax Increment Financing in September 1990 and completed in May 1991. Upon completiov~ Of tl/e work, the prime contractor, Noble Nursery, Inc., was unable to make payment to their su~nWactors. For this reason, the retainage was withheld and final payment was not made. RecCatly~ lien waivers have been received from the subcontractor and a check by the City Attorney h~!shown that there are no liens against the project. The project can now be finaled out. Motion by C0unl~ilmember Peterson and seconded by Councilmember Hardin to adopt Resolution g92-07-171 authorizing Change Order No. 1 and issuing Payment No. 4 as final payment to Noble Nursery, Ilic~ for Project//90-30. Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Hardin, Peterson and Zimmerman.. VOting No: None. Case #6: Review of Interim Use Permit for Auto Repair/Towing Approved for IsSuance to Fred Dinnetz. Zoning Administrator Frolik discovered that Mr. Fred Dinnetz was no longer associated with A.T.H. Th¢}nt0rim use permit was issued to Mr. Fred Dinnetz personally, and it was to expire coincidentally With his relocating the auto repair facility from the subject site or one year, whichever aame first. Greg Isaacs, on, attorney for Mr. Stanley Browning, stated that Mr. Browning is the sole owner of A.T.H. and :tl~at Mr. Dinnetz had only been an employee. Mr. Isaacson cited that the expiration of the ~ntertm~;t~se permit was contingent upon departure of the business, not Mr. Dinnetz. Mr. Isaacson reqttested to have the interim use permit reissued in Mr. Browning's name. Motion by C0un¢ilmember Peterson and seconded by Councilmember Zimmerman to reissue the interim use: permit to Mr. Stanley Browning until May 27, 1993 on the condition that Mr. Browning ~t~es with him all items that are his when he moves and will identify, for a City Staff member, tho~ items that are not. Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Peterson and Zimmerman. Voting No: CouncilmemberHardin. Case #8: Request for Final Plat Approval of Windemere Woods 2nd Addition; case of Windemere Woods of Ramsey, Allen Koenig. Zoning Administrator Frolik stated that Allen Koenig has requested final plat approval of Windemere iWoo~:ls 2nd Addition. The issue of park dedication requirements was resolved with the development of the first phase. Motion by !~ouricilmember Zimmerman and seconded by Councilmember Beyer to adopt Resolution #9,2-07-172 granting final plat approval to Windemere Woods 2nd Addition. Motion carded.
