<br />Councilmember Look introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #08-03-061 <br /> <br />A RESOLUTION APPROVING AN INTERIM USE PERMIT TO ALLOW <br />ADDITIONAL OUTDOOR USES AT 7550 HIGHWAY 10 NW (DIAMONDS SPORTS <br />BAR AND GRILL), BASED UPON FINDINGS OF FACT #0823 AND DECLARING <br />TERMS OF SAME. <br /> <br />WHEREAS, Monster Auctions & Events, Inc., a Minnesota Corporation, (the <br />"Permittee") has properly applied for an interim use permit on the property legally described as <br />follows: <br /> <br />Lot 1, Block 1, The Diamonds, Anoka County, Minnesota <br /> <br />(the "Subject Property"); and <br /> <br />WHEREAS, the City Council has adopted findings of fact related to the Permittee's <br />application by its Resolution #08-03-060 <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That based on the foregoing findings of fact, the City Council conclude that an Interim Use <br />Permit ("IUP") may be granted to the Permittee conditioned upon the following: <br /> <br />1) The following additional one-day uses are herby permitted on the Subject Property, in <br />addition to those uses approved pursuant to the 2000 Conditional Use Permit previously <br />issued for the subject property: <br /> <br />a. Small-Scale events including Farmer's Markets, Flea Markets Swap Meets, and <br />Car Shows (up to twenty (20) per summer) <br />b. Large-Scale Implement Auctions (boats, cars, etc.) (up to ten (10) per summer) <br /> <br />2) The number of events is limited to two (2) per winter season (October through April) and <br />thirty (30) per summer season (May through September), and must be approved by the <br />City pursuant to Permittee's schedule of events; exact dates are flexible with compliance <br />of the aggregate number of events pursuant to the permit. Not withstanding the above, in <br />no event shall the number of events exceed thirty in anyone calendar year. <br /> <br />3) These IUP uses are for a one year term commencing on the date of approval of this <br />permit. This IUP is defined in Section 9.03.06 of City Code. City Staff will monitor the <br />events for any problems related to traffic, crowd control, noise, and other issues related to <br />public safety. The IUP shall be eligible for an additional one year extension beyond the <br />expiration date in accordance with the following: <br /> <br />a. On or before March 25, 2009, the City Council shall review the IUP for <br />compliance with its terms. Upon satisfactory review, the City Council may issue <br />an IUP extension for an additional one year term. <br />
