The Public Hearing requirement for a new IUP is waived; however, adjacent <br />property owners will be notified of the date the City Council conducts the one <br />year review and extension request. <br />c. The Permittee shall not be responsible for standard application and expenses <br />incurred by the City in considering the issuance of a second term. <br /> <br />All permitted uses shall be conducted within the softball fields as shown on the site <br />layout as attached hereto and incorporated as Exhibit A. <br /> <br />The Permittee will meet with City Staff to review all event details no less than two weeks <br />prior to each event. The applicant will not be exempt from state, county, and local <br />permits, excluding the local Special Events Permit. The City retains the authority to <br />conduct the inspection under the same review parameters it would under a Special Events <br />Permit process for this review. <br /> <br />Any improvements, including financial investment, the Permittee may make in reliance <br />on this IUP SHALL NOT be considered as factors by the City in the event the Permittee <br />applies for an extension of the IUP. <br /> <br />The development and operation of the outdoor uses shall be specifically limited to that <br />described in the Permittee's site layout and letter from the applicant dated January 25, <br />2008, submitted as part of the IUP application. <br /> <br />The Permittee shall provide sufficient off-street parking in accordance with the approved <br />site plan and City Code performance standards. <br /> <br />9) <br /> <br />A Schedule of Events (including dates and times) for all events for the Subject Property <br />is attached hereto and incorporated as Exhibit B. A new Schedule of Events for the <br />Subject Property shall be submitted to the City no later than January 1, 2009. <br /> <br />10) <br /> <br />Building and parking lot lighting changes are subject to the approval of the City <br />Engineer, shall be arranged to deflect light away from adjoining properties and public <br />streets, and bulbs emitting in excess of 3,000 lumens shall be so directed that the bulb is <br />not visible from off of the Subject Property where such light source is located. <br /> <br />Any outdoor public address system or any sound emitting from the property may not <br />exceed the noise performance standards contained in City Code, and that, upon validated <br />complaints, such system's volume shall be reduced or the event causing the noise ceased. <br />Speakers must be directed away from adjacent residential areas. In addition the use of <br />public address system shall be limited to the Large-Scale Implement Auctions. <br />a. No public address system shall be operated between the hours of 7 p.m. and 7 <br />a.m. In addition the pa systems shall be limited to such that it does not transmit <br />sound at a volume in the excess of that reasonably necessary for the convenient <br />hearing of the person on the subject property and SHALL NOT BE audible from <br />the property line of the subject property. <br /> <br />12) <br /> <br />Any new signage proposed for the Subject Property must meet City Code requirements. <br /> <br />RESOLUTION #08-03-061 <br />Page 2 of 6 <br />
