<br />2. The following are to be considered as nighttime or Sunday <br />uses: Auditoriums incidental to a public or parochial <br />school, churches, bowling alleys, dance halls, theaters, <br />retail stores, personal service shops, bars or restaurants. <br /> <br />3. Up to 50% of the parking facilities required for nighttime <br />uses may be supplied by the off-street parking facilities <br />provided by daytime uses and vice versa. <br /> <br />4. Conditions required for joint use: the proposed joint <br />parking space is within 500 feet of the use it will serve; the <br />applicant shall show that there is no substantial conflict in <br />the principal operating hours of the two buildings or uses <br />for which joint . use of off-street parking facilities is <br />proposed. <br /> <br />5. A properly drawn legal instrument executed by the parties <br />concerned for joint use of off-street parking facilities shall <br />be filed with the Zoning. Administrator, which shall run <br />. with the land and. be recorded with the County Recorder's <br />office. <br /> <br />(Actually, for clarity purposes, staff would suggest that all of Subdivision 1 be relocated <br />to 9.11.09 which addresses commercial off street parking standards and requirements <br />This Section, 9.11.08, should address residential off street parking requirements only.) <br /> <br />Subd. 2. Residential Development. <br /> <br />a. In any Residential District, indoor parking of licensed and/or <br />unlicensed motor vehicles and equipment ("Items"), commercial or <br />private, operable or inoperable, in any number, shall be permitted. <br /> <br />a. In any Residential District, 00 outside parking of any motor <br />vehicle(s) and/or equipment is restricted to the following <br />performance standards: shall be permitted, EXCEPT as follows: <br /> <br />1. A total of five (5) items may be parked or stored outside on <br />parcels less than 5 acres (217.799 square feet or less) in size. <br />2. A total of eight (8) items may be parked or stored outside on <br />parcels 5 acres or greater (217.800+ square feet) in size. <br />3. The restriction to the number of items parked or stored outside <br />shall apply to . the total of all items. including those items <br />parked or stored on the driveway. in the side yard. or in the rear <br />yard. <br /> <br />03.06.08 <br /> <br />-8- <br />
