Background: <br />CASE #: <br />REQUEST FOR FINAL PLAT REVIEW OF EBONY WOODS; <br />CASE OF TIM HOLM <br />By Tim Gladhill <br />a <br />Tim Holm submitted a final plat to develop three single - family units on the property located on <br />the east side of Ebony Street N.W., just south of the Superbowl facility. The following items are <br />enclosed for your information: <br />a) Site location map <br />b) . Final Plat <br />c) Site Development Plans <br />d) City Staff review letter dated June 6, 2008 <br />e) Proposed Resolution granting final plat approval <br />f) Proposed Development Agreement <br />Notification: <br />No public hearing is required at the final plat for a minor subdivision. However, the City Council <br />adopted a policy requiring notification of a proposed subdivision be sent out to residents within <br />350 feet of the subject property during sketch plan submittal. In addition, the application also <br />included a variance to lot width. Property owners within 700 ft. of the Subject Property were <br />notified of the Public Hearing related to the variance. <br />Observations: <br />The subject property is approximately 1.1 acres in size and is zoned R -1 Residential and is within <br />the Metropolitan Urban Services Area (MUSA). A Comprehensive Plan Amendment from <br />Places to Shop to Places to Live, as well as a re- zoning from B -2 Business to R -1 Residential, <br />has already been approved. <br />The permitted density in the R -1 Residential District is 1 -3 units per acre. The sketch plan <br />proposes 3 units on the 1.1 acres. This equates to a density of 2.72 units per acre, which meets <br />City Code standards. <br />The property is located in the Mississippi River Overlay District. The District requirements state <br />that the project shall preserve 50% of the land as open space and restrict impervious (rooftop and <br />pavement) to 25% of the lot area (or up to 35% with a Conditional Use Permit). The proposed <br />plat meets the open space and impervious surface requirements with 81% open space and 19% <br />impervious surface. It is also noted that the maximum structure height in the Overlay District is <br />35 feet. If this project goes forward, compliance with the height requirement must be verified. <br />
