City Administrator Ulrich suggested that there could be a sliding scale for late penalties. <br />Pawnbroker License Revocation <br />Councilmember Jeffrey stated that in looking at the cost for the administrative hearing for the <br />pawnbroker, it cost $5,200 and asked if there was any way to assess the business for these costs. <br />City Administrator Ulrich stated that normally you cannot assess these fees back, but the City <br />does have a lease arrangement with this business, so he can take a look at the lease and see if <br />there is anyway some of these costs can be recouped. <br />Councilmember Dehen stated that he didn't like the fact that the Council got back into the facts <br />of the case because there had already been a hearing examiner hired to assess the credibility of <br />the case. He stated that, in his opinion, either the Council assesses the credibility or the City lets <br />someone else do it because he doesn't think it is appropriate to get into the factual issues as a <br />Council if there is a hearing examiner. <br />Councilmember Olson stated that she went to the pawnshop the day after the last Council <br />meeting and spent 11/2 hours looking into the computer system. She stated that after seeing the <br />system, she thinks the Council was right to give the owner a break. <br />Councilmember Look asked how many administrative hearings the City handles in which a <br />hearing examiner is hired. <br />Community Development Director Miller stated that she felt a hearing examiner was probably <br />hired in about 75% of the cases. <br />Councilmember Dehen noted that the City does not recoup any of those costs. <br />ADJOURNMENT <br />The Work Session of the City Council was adjourned at 8:28 p.m. <br />Respectfully submitted, <br />Kurds G.
