He stated that in another instance, someone found their item on E-bay the very next day, <br />which is another violation, because items are supposed to be held for 30 or 60 days. <br /> <br />City Attorney Goodrich noted that the paper distributed by Police Chief Way was just' a <br />summary of some of the violations and incidents that have happened. <br /> <br />Mayor Gamec stated that he does not want this to become a known place for fences to get rid of <br />stuff and he thinks that the City should shut down this business. He stated that he does not have <br />much sympathy for the owner because of the repeated violations. <br /> <br />Councilmember Jeffrey stated that our police department has gone and worked with this <br />individual on numerous occasions, so he doesn't feel his excuse can be that he doesn't know <br />what is happening. He stated that he doesn't feel he needs to hear anymore about the process <br />and agrees that the license should be revoked. <br /> <br />Councilmember Dehen asked if it was outlined in the City Code that this license needed to be <br />revoked publicly at the Council meeting. <br /> <br />Councilmember Strommen stated that the Council cannot take action at a work session. <br /> <br />City Attorney Goodrich distributed information from Chapter 7 of the City Code. He reviewed <br />sections 7.13.16, 7.13.11 and 7.01.08. He stated that the owner will be informed that this will be <br />on the Council agenda on Tuesday night. He stated that he suspects the owner will want to talk <br />the Council and some comments should be heard. He cautioned against Council giving Mr. <br />Jerdin a chance to review the facts of the case again. <br /> <br />Councilmember Elvig stated that it will boil down to Mayor Gamec facilitating the meeting. <br /> <br />City Attorney Goodrich suggested that he was also willing to facilitate the discussion for this <br />topic at the Council meeting. <br /> <br />Councilmember Look asked when Mr. Jerdin had taken over this business. <br /> <br />Police Office Manager Weimann stated that he took over the business in July 2007. <br /> <br />Councilmember Look stated that is less than a year. <br /> <br />Police Chief Way stated that he met with Mr. Jerdin personally in October after some of the <br />violations were noted, but the problems continued. He cited an example from November 27, <br />2007 where he (Jerdin) entered a fictitious date of birth for someone as 1/1/1111 and December <br />27, 2007 where he allowed someone to sign with a fictitious name. He stated that these <br />examples are not mistakes but deception. <br /> <br />Councilmember Look asked if this could just have been an error on the part of the owner. <br /> <br />City Council Work Session / May 20, 2008 <br />Page 4 of8 <br />
