<br />Councilmember Strommen stated that she feels this goes directly against the health, safety and <br />wellness of the community because this is becoming an entity that is known as a safe haven to <br />get rid of stolen goods which brings in an element that the City doesn't need or want. <br /> <br />Councilmember Elvig stated that he has no problems with pawn shop businesses that are <br />operated correctly and has had a lot of fun shopping in them in the past. <br /> <br />City Attorney Goodrich distributed copies of the transcript from the hearing with the owner and <br />encouraged them to page through it. <br /> <br />Police Chief Way stated that if the license is revoked, there will need to be a system set up where <br />people who have items at the shop can come and retrieve them. <br /> <br />City Attorney Goodrich reiterated that this is a very important issue and while the Council <br />should give the owner courtesy at the Council meeting, keep it brief. <br /> <br />Councilmember Dehen stated that he feels the City should revisit our ordinances and tighten up <br />the language surrounding someone who has had a license revoked, that the City will not allow <br />them to be employed in that same capacity. <br /> <br />City Attorney Goodrich stated that this is actually covered in Section 364.03 and read a portion <br />aloud that noted that there did not need to be a conviction of an individual to deny the <br />application. <br /> <br />Councilmember Dehen stated that he feels there needs to be a time when the City switches from <br />"mercy mode" to "consequence mode" and while he wants to see a new business succeed, the <br />"mistakes" in this case seem to actually be intentional acts. He stated that he knows, and has <br />worked with, Mike Scott who was the Hearing Examiner in this case and has found him to be <br />well respected and very skilled. He stated that if Mike Scott recommends revocation, that gives <br />this credibility, in his mind, because he respects Mr. Scott's opinion. <br /> <br />City Attorney Goodrich stated that he will take a close look at the language in the City Code and <br />review it with Police Chief Way to make sure that there isn't any wording that should be <br />changed or tightened up. <br /> <br />Councilmember Look read aloud a portion of the transcript where Mr. Jerdin stated that he didn't <br />want to work with thieves. He stated, to him,. this shows some doubt about the deception <br />allegations and noted that he feels the Council is just "throwing him under the bus". <br /> <br />Mayor Gamec stated that it appears that the majority of the Council does not have doubt about <br />Mr. Jerdin's actions and stated that Councilmember Look can vote how he would like at the <br />Council meeting. <br /> <br />Councilmember Dehen stated that the Council is not in the position to fact find and noted that the <br />City hired somebody to do that for us and the City either listens to that expertise or takes it over <br />and does it ourselves. <br /> <br />City Council Work Session / May 20, 2008 <br />Page 6 of8 <br />
