<br />Councilmember Dehen stated that he does not want to go to the expense of having another <br />hearing if there are other violations. He suggested tabling the revocation and to rely on our law <br />enforcement to give the Council guidance on whether there are violations or not. <br /> <br />City Attorney Goodrich stated that he did not think that satisfied due process and noted that the <br />Police Department has stated that there are violations. He stated that he doesn't think the City <br />should try to pressure Mr. Jerdin into waiving his rights. <br /> <br />City Administrator Ulrich noted that the Council can hold a future hearing itself and would not <br />have to hire an outside hearing examiner. <br /> <br />Councilmember Dehen asked if the Council could revoke the license, but stay the revocation and <br />suspend it for 30 days and, if there are no reported violations from the Police Department, <br />reinstate the license. <br /> <br />City Attorney Goodrich stated that the violation would need to be proven, not just a reported <br />violation. <br /> <br />Councilmember Look asked if a hearing could be held during a work session. <br /> <br />City Attorney Goodrich stated that there would need to be a Special Council meeting because no <br />action can be taken at a work session. <br /> <br />A man from the audience stated that he had been listening at home and would like to make a <br />comment. <br /> <br />Mayor Gamec noted that this is not a public hearing, so he could not make comments to the <br />Council. <br /> <br />City Attorney Goodrich gave a language recommendation for the motions. <br /> <br />Motion by Councilmember Look, seconded by Councilmember Olson, to adopt Findings of Fact <br />and Conclusions of Hearing Examiner Scott dated April 28, 2008 regarding the license issued to <br />Ralph's Gun and Pawn for operation of a pawnbroker business at 6101 Highway 10 NW, <br />Ramsey, MN. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Look, Olson, Dehen, Jeffrey, <br />Strommen. Voting No: None. Absent: Councilmember Elvig. . <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Look, that based on the Findings of Fact <br />and Conclusions of the Hearing Examiner Scott dated April 28, 2008 regarding the license issued <br />to Ralph's Gun and Pawn for operation of a pawnbroker business at 6101 Highway 10 NW, <br />Ramsey, MN, that the license be suspended for a period of 30 days beginning June 1, 2008 <br />through June 30, 2008, and during this time the licensee can operate as a second hands goods <br />dealer only, that staff be directed to place a review of the license on the agenda 120 days from <br />May 27,2008 for discussion. <br /> <br />City Council / May 27, 2008 <br />Page 12 of 15 <br />
