Case #3: [!Request for a Conditional Use Permit to Establish an Auto <br /> i R~pair/Towing Service/New Parts Sales Facility at 14600 Nowthen <br /> : BOulevard N.W.. (PIN #25-32-25-23-0006); Case of Fred Dinnetz of <br /> ~ ATH, INC. <br />Commissiorte~ Deemer stated he will participate in the review of the findings of fact; however, he <br />will abstain ~Om voting on the conditional use permit. <br /> [ <br />Commissione¢ HCndriksen stated there has been a long history of issues relating to this property <br />and he wotfid re,1 uncomfortable recommending the approval of this conditional use permit <br />because of t~e pi'evious conditional use permit. He inquired why there was no background <br />information provided for the last CUP. <br /> <br />Zoning Administrator Frolik stated she did not include background information germane to the <br />previous CU~be~ause Mr. Fred Dinnetz is applying for the conditional use permit, not Mr. Gerald <br />Root. Everi though Mr. Dinnetz is asking for an 18~month CUP, he will be purchasing the <br />property froml'Mr~ Root as an investment property. <br /> <br />Commissioner Hendriksen stated that the property is still under Mr. Gerald Root's ownership. <br /> <br />Attorney Isaacson stated that the purchase agreement has been signed by Mr. Root and Mr. <br />Dmnetz, contingent upon the condinonal use permit, the zomng, etc. <br /> <br />Ms. Frolik stated .that the date of the Conditional Use Permit could coincide with the sale of the <br />property to Mw. Dinnetz; therefore, if the sale fails, there will be no conditional use permit granted. <br /> <br />The Commisslon ~roceeded to review the findings of fact. <br /> <br />Commissioner Deemer stated there is an error in Item #6 which reads "That the adjacent parcels to <br />the west and:s~utll are zoned R-3 Urban Residential, the parcel t,o, the north and the property across <br />Nowthen BOulevard to the east is zoned R-1 Urban Residential '. He stated the parcel to the west <br />is zoned R-1.' <br /> <br />Zoning Admifiistrator Frolik stated she would verify this. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to amend #11 to read <br />"That the propbsed use will adversely impact traffic in the area". <br /> <br />Motion carrie[l. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Holland, <br />Hendriksen ar/d LaDue. Voting No: None. Absent: Commissioner Thomd. <br /> <br />Motion by Commissioner Terry and seconded by Commissioner Holland to amend #12 to read <br />"That the pro_ r~_sed use will,,not be dangerous or detrimental to persons residing or working in the <br />vicinity of th~.proPosed use . <br /> <br />Motion carrieO. Voting Yes: Chairperson Bawden, Commissioners Terry, Holland, Deemer, <br />Hendriksen an~l~ LaDue. Voting No: None. Absent: Commissioner Thorud. <br /> <br />Motion by CoBamissioner Hendriksen and seconded by Commissioner Deemer to amend #13 to <br />read "That th~, proposed use will substantially or adversely impair the use, enjoyment or market <br />value of surr0~inding properties". <br /> <br />Further discussion: Commissioner Deemer stated it will adversely impair his property with the <br />improvements!ihe Will be installing to rebuild to its best use following the fire. <br /> <br />Planning <br /> <br />& Zoning Commission/April 6, 1992 <br /> Page 4 of 7 <br /> <br /> <br />
