<br />The submitted site layaut appears to. be nan-confarming to. front yard setback. The applicant has <br />stated that a measurement was taken an the praperty to. ensure that the 40 faat frant yard setback <br />was in compliance. Hawever, it wasdiscavered that the measurement was taken fram the edge <br />af the. roadway and nat the praperty line. The applicant has. stated that the building will be <br />maved back to. comply with frant yard setback. The site layaut will be revised at building permit <br />review stage. The prapased Canditianal Use Permit includes language that the structure shall <br />camply with all applicable setbacks. <br /> <br />As the Cauncil may recall, City Code was recently amended in May af 2006 to. increase the <br />amaunt of accessary structure .square faatage allawed an parcels af this size. Since the amaunt <br />of accessary structure space all awed was increased, the City has received ane. CUP applicatian <br />aside from this current applicatian for accessary structure space average. <br /> <br />Furthermare, staffis also. warking an a prapasal to. increase the tatal square feet allawed in each <br />zaning district by 200 square feet. This prapasal will also. begin including accessary structures <br />less than 120 square feet into. the tatal calculatian af allawed square faatage and number af <br />accessary structures allawed. It is nated that in the event this prapasal is appraved, the applicant <br />wauld still be aver the maximum square faatage all awed and wauld sti1lneed a Canditianal Use <br />Pennit. <br /> <br />Funding Source: <br /> <br />All casts assaciated with pracessing af the Conditianal Use Permit applicatian are the <br />respansibility af the applicant. <br /> <br />Recommendation: <br /> <br />Planning Cammissian met an June 5th to. hald a Public Hearing regarding the CUP request and <br />recammended approval af the Canditianal Use Permit far a 570 foat average af accessary <br />structure space basedon Findings afFact favarable to. the applicant. <br /> <br />Commission Action: <br /> <br />Matian to. adapt Resalutian #08-06- adapting Findings af Fact # _ relating to. the <br />applicant's request far a canditianal use permit to. exceed the amaunt af accessary structure space <br />allawed an the subject property. <br /> <br />-and- <br /> <br />Matian to. adapt Resalutian #08-06-xxx approving the applicant's request far a canditianal use <br />permit to. exceed the amaunt af accessary structure space allawed an the praperty, declaring <br />terms af same. <br /> <br />-ar- <br /> <br />-200- <br />
