HORTON INC.-MINNESOTA <br />Dated November _, 2003 <br /> <br />The temlS and conditions of the aforementioned agreements are incorporated herein by <br />reference as if fully set forth at this point. DEVELOPERS further acknowledge, by <br />execution of this Agreement, receipt ora copy of the aforementioned agreements. <br /> <br />In the event of a conflict between the tenns of this Agreement and the terms of the <br />aforementioned agreements, this agreement shall control. <br /> <br />3. Conditions of Approval. The CITY hereby approves the Plat on condition that: <br /> <br />a. the DEVELOPERS enter into this Agreement, and <br /> <br />b. the DEVELOPERS provide the necessary security in accordance with the <br />terms of this Agreement. <br /> <br />4. Development Plans. The DEVELOPERS shall develop the Plat in accordance <br />with the plans prepared by James RHill, Inc. dated January 7, 2008~ as amended per City Staff <br />review letters. The plans shall not be attached to this Agreement, but are in CITY files <br /> <br />5. Stage I Improvements Required.
