most likely be required. There is apotential that State or City banking credits could be
used to satisfy this requirement. See attachment 2.

2. Revert bagk to the preliminary design, and work to. acquire a portion of the property at
7131 166 Avenue. Theproperty owner has not taken or returned multiple calls from
staff in an attempt to explain what has been done since the preliminary design was first
put forth, and the impacts ofthose revisions. We are attempting to complete our due
diligence and provide all the information to the homeowner so he can make an informed
decision, but to date he is unwillip.g to listen. See. attachment 1.

3. Go back to the original segment one boundaries an~ stop the project at Limonite Street.
Doing so would eliminate the need for any acquisition on the westerly end of the project,
aside from some temporary construction easements. All the work could be completed
without any taking of property. This approach would result in project redundancy or a
larger taking in the future if/when the roadway curvature along 166th.Avenue is corrected.

Staff Recommendation:

Staff recommends option 2 above. This may result in the use of eminent domain to acquire a
portion ofland from 7131 166thAvenue NW. lfthe City is goingto reconstruct this road to State
Aid standards, than this approach would resolve the situation now and be the least impactful to
property owners and the environment.

Funding:

This entire roadway project including design, acquisition, street and trail construction, storm
sewer installation, landscaping, and potential wetland impacts/mitigation are proposed to be paid
for with MSA funds. It is estimated that total MSA expenditures for this project are $875,000.
The sanitary sewer and watermain portions of this project are proposed to be funded through
their corresponding Utility.Funds. It is estimated that $190,000 would be financed through the
Water Utility Fund, and $250,000 through the Sewer Utility Fund.

Council Action:

. Motion to approve Resolution 08-06-XXX authorizing the acquisition of a portion of the
property located at 7131 166thAvenue NW.

Attachments:

Figure.1 - Preliminary Layout
Figure 2 - Proposed Design
Resolution

Reviewed by:

Assistant City Engineer
Public Works Director/Principal En~eer
~ City Administrator .F) ~ 'F...--A..

CC: 6/24/08

-316-
