<br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />#08-06-XXX <br /> <br />RESOLUTION APTHORIZING ACQUISITION OF FEE TITLE TO CERTAIN <br />PROPERTY NECESSARY FOR THE REALIGNMENT OF 166TH AVENUENW <br /> <br />WHEREAS, the City finds it necessary and in the public interest to realign 166th Avenue <br />NW to serve the public transportation needs of the City's residents (the "Public Improvement <br />Project"); and <br /> <br />WHEREAS, the Public Improvement Project is identified on the City's master municipal <br />transportation plan; and <br /> <br />WHEREAS, the City has acquired by direct negotiation the. certain rights of way <br />necessary for the Public Improvement Project; and <br /> <br />WHEREAS, it is necessary to acquire fee title to certain other parcels; and <br /> <br />WHEREAS, the legal description of the property to be acquired in fee title is asfollows: <br /> <br />see attached EXHIBIT A <br /> <br />(the "Fee Title Property"); and <br /> <br />WHEREAS, the City declares that it is in the public interest to acquire the Fee Title <br />Property above described; and <br /> <br />WHEREAS, the City has authority to acquire the Fee Title Property for the Public <br />Improvement Proj ect by eminent domain pursuant to Minn. Stat. Chapter 117; and <br /> <br />WHEREAS, the City has the right to acquire title and possession of the Fee Title <br />Property prior to the filing of an award by the Court appointed commissioners, pursuant to Minn. <br />Stat. g117.001 and g117.042; and <br /> <br />WHEREAS, the City finds and declares that it is in the public interest to acquire title to <br />and possession of the Fee Title Property prior to the filing of an award by the Court Appointed <br />Commissioners; and <br /> <br />WHEREAS, the property owner of the Fee Title Property and the Anoka County PIN for <br />the said Property Interests have been identified by the City as follows: <br /> <br /> <br />-319"- <br />
