<br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, AS FOLLOWS: <br /> <br />1. That in orderto carry out the purposes and objectives described above it is necessary to <br />. acquire the Fee Title Property. <br /> <br />2. The acquisition of the Fee Title Property by exercise of eminent domain in the manner <br />provided by Minnesota Statute Chapter 117 serves a public interest and is deemed to be <br />necessary. <br /> <br />3. The City deems it necessary for the reasons set forth above to proceed without delay <br />under Minn. Stat. S 117.042 to pay to the owners or into. court a sum of money to serve as <br />compensation to the owner of the Fee Title Property, which amount shall be equal to <br />Petitioner's approved appraisal of value as determined by the City. <br /> <br />4. That the City Administrator is hereby directed to acquire the Fee Title Property as <br />described above in accordance with Minnesota Statutes. The City Administrator is <br />authorized to negotiate and represent the City of Ramsey in all proceedings. <br /> <br />5. That if the Fee Title Property cannot be acquired by direct negotiation, they shall be <br />acquired by eminent domain. <br /> <br />6. That the City Council hereby authorizes acquisition of the Fee Title Property by eminent <br />domain and to take title and possession of that land prior to filing of an award by the <br />Court Appointed Commissioners pursuant to Minn. Stat. Sll7.011 andSI17.042. <br /> <br />7. That the City Attorney is authorized to file the necessary petition therefore, and to <br />prosecute such action to a successful conclusion or until it is abandoned, dismissed or <br />terminated by the City or Court. <br /> <br />8. The City Administrator is authorized to expend necessary funds for appraisals of the Fee <br />Title Property. <br /> <br />The motion of the adoption of the foregoing resolution was duly seconded by Councilmember . <br />, and upon vote being taken thereon, the following in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />....320- <br />
