2) City ~. ou0cil special meeting minutes dated August 3, 1992. <br /> <br />PUBLIC HEARING <br />Chairperson Bawden adjourned the regular Commission meeting in order to conduct the following <br />public heatings: <br /> <br />1) ReqlaCst fOr a conditional use permit for professional offices and retail activity in the B-3 <br /> High~ay Business District; Case of William Dubats <br /> <br />2) Request to vacate dedicated street easement between P.I.N. 28-32-25-31-0004 and P.I.N. <br /> 28-32¢25~31-0003; Case of John and Peter Kovar. <br /> <br />Chairperson Bawden called the regular meeting of the Planning and Zoning Commission back to <br />order at 7:37 ~.m:, <br />COMMISSIoN BUSINESS <br /> i R~quest for a Conditional Use Permit to Establish Professional <br />Case #1: '~ Offices and Retail Sales in the B-3 Highway Business District; Case <br /> of William Dubats <br /> <br />Mr. William~ubats was present and stated that from 1976 to 1981 the building at 6740 - Highway <br />#10 N.W. ~a~ us~l as an office building. He feels professional offices and retail sales represents <br />the best and bigfiest use for this property. He added he is comfortable with the terms of the <br />proposed con~lliti0nal use permit. <br /> <br />Zoning Adm}lnistrator Frolik stated that this particular building has previously been under <br />conditional u~ ~p~Xrnits for a variety of uses; however, all have gone void due to discontinuance for <br />12 consecutiv~ months or more. <br /> <br />The Planning and Zoning Commission proceeded to review the findings of fact relating to Mr. <br />Dubats request for a CUP. <br /> <br />Motion by C~mniissioner Deemer and seconded by Commissioner Terry to amend #11 to read <br />"That the prO~os .~l use will not be dangerous..."; #12 to read "That the proposed use will not <br />substantially ~pr a~lversely impair the use, enjoyment or market value..."; #13 to read "That the <br />proposed usei will be harmonious with and in accordance with..."; #14 to read "That the <br />proposed use ~vil[' be operated and maintained in order to be harmonious..."; #15 to read "That <br />the proposed ~sei~will not be hazardous or disturbing..."; #16 to read "That the proposed use <br />will be an i~pr(~vement to the property . . ."; #17 to read "That the proposed use will be <br />adequately Se~ed by essential public services..."; #18 to read "That the proposed use will not <br />create excesSiVe 0,dditional requirements.., and that the proposed use will not be detrimental.. <br />."; #19 to read "That the proposed use will not involve uses, activities or processes that will be <br />detrimental '" <br /> <br />Motion can'ieXt. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Hendriksen, <br />Holland, LaDle and Thorud.
