<br />City Engineer/Public Works Department to do the following on the Subject Roadway: a) Clear <br />the trees/growth 18 feet on each side of the centerline; 2) Grub stumps and grade roadway to a <br />width of 36 feet; 3) Place Minimum Maintenance Roadway signs as required by State Statute. <br /> <br />Further Discussion: Councilmember Strommen confirmed that the City will inspect this road <br />annually. Public Works Director Olson stated that the City will inspect this annually. <br />Councilmember Olson stated that she thinks there is too much opposition based on Mr. Kaas' <br />comments and cannot support this motion. Councilmember Look asked why the City wasn't <br />putting through a road. Public Works Director Olson stated that it is not being put through <br />because there isn't a subdivision request that would require a need for the additional roadway. <br />He stated that from a traffic perspective, there hasn't been a need to spend the many thousands of <br />dollars it would take to make a roadway connection across the wetland area. Councilmember <br />Dehen stated that Councilmember Olson had voted in favor of this issue in the Public Works <br />Commission meeting and asked why she would now vote against it. Councilmember Olson <br />stated that she doesn't think the issue is going to go away because there is still too much <br />opposition. <br /> <br />Amended Motion carried. V oting Yes: Mayor Gamec, Councilmembers Jeffrey, Dehen, Look, <br />and Strommen. Voting No: Councilmember Olson. Abstaining: Councilmember Elvig. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Jeffrey, to adopt Resolution #08-131 <br />declaring the Subject Roadway as a Minimum Maintenance Roadway, subject to Greg Bauer's <br />and spouse's agreement to sign a hold harmless agreement holding the City harmless for any <br />liability from injuries to persons on property concerning the City's designation of the Subject <br />Roadway as a Minimum Maintenance Roadway. ' <br /> <br />Further Discussion: Councilmember Look asked if the City constructed this to City standards <br />whether the costs can be assessed to the properties. City Attorney Goodrich stated that it cannot, <br />unless the property owners petition for this. Councilmember Look asked if Mr. Bauer can <br />simply neglect the road to force the City to take it over. City Attorney Goodrich stated that this <br />is a possibility. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Jeffrey, Dehen and Strommen. <br />Voting No: Councilmembers Look and Olson. Abstaining: Councilmember Elvig. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Jeffrey, to permit Greg Bauer to place an <br />address sign at the entrance to the Subject Roadway. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Jeffrey, Dehen, Look, and <br />Strommen. Voting No: Councilmember Olson. Abstaining: Councilmember Elvig. <br /> <br />Case #7: <br /> <br />Adopt Ordinance Amending Section 5.08 (public nuisances) of Chapter 5 of <br />City Code; Case of City of Ramsey <br /> <br />Community Development Director Miller stated that this ordinance has been rewritten to make <br />the definition of "inoperable vehicle" easier to understand and apply. <br /> <br />City Council / July 22, 2008 <br />Page 16 of23 <br />
