<br />Motion by Councilmember Jeffrey, seconded by Councilmember Olson, to waive the reading as <br />required by City Charter and adopt Ordinance #08-20 to amend Section 5.08 (Public Nuisances) <br />of City Code. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Dehen: aye <br />Councilmember Strommen: aye <br />Councilmember Jeffrey: aye <br />Councilmember Olson: aye <br />Councilmember Look: aye <br />Councilmember Elvig: aye <br />Mayor Gamec: aye <br /> <br />Motion carried. <br /> <br />Case #8: <br /> <br />Adopt an Ordinance Amending Chapter 5 of the City Code to Include Social <br />Host Liability <br /> <br />Police Chief Way stated that there have been minor changes to the ordinance since the last <br />meeting. <br /> <br />Councilmember Dehen noted that section 5.22.02 (5) states that "the person fails to take <br />reasonable steps to prevent possession or consumption by the underage person(s)". He stated <br />that, for example, what if there is liquor kept in a pole barn by parents but it isn't locked up. He <br />asked what would prevent law enforcement from saying that they didn't take reasonable steps. <br /> <br />City Attorney Goodrich stated that law enforcement won't charge unless they think they can <br />convict and they will need to use common sense for what is considered reasonable and what <br />isn't. He stated that this will need to be handled on a case by case basis. <br /> <br />Police Chief Way stated that he understands that there is some concern about the word <br />"reasonable", but in his research he found it used over 500 times in Minnesota Statute language. <br />He stated that he was unable to come up with another word. <br /> <br />Motion by Councilmember Look, seconded by Councilmember Strommen, to Adopt Ordinance <br />#08-21 amending Chapter 5 of City Code, which is known as the Municipal Regulations chapter <br />of the city Code of Ramsey, Minnesota. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Strommen: aye <br />Councilmember Jeffrey: aye <br />Councilmember Olson: aye <br />Councilmember Dehen: aye <br /> <br />City Council / July 22, 2008 <br />Page 17 of23 <br />
