IN THE MATTER OF THE CONDEMNATION OF CERTAIN LANDS IN TI °IE CITY OF RAMSEY, COUNTY OF ANOKA., STATE OF MINNESOTA, FOR STREET, DRAINAGE AND UTILITY IMPROVEMENT PURPOSES This Settlement Agreement is made and entered into by and between Respondents Francis J, Kaas and Lorri M, Kaas. (collectively "Kaas ") and the City of Ramsey, a Minnesota municipal corporation (the "City "). WHEREAS, The City has commenced an eminent domain proceeding against the property of Kaas, ct,al, for the purpose of acquiring a permanent easement for right of way for roadway purposes. and the parties have agreed to a settlement which settles all issues outstanding between them. NOW, THEREFORE, in consideration of the mutual covenants contained in this Agreement: 1. Payment for Damages. The City shall pay a total sum of $36,100.00 to Respondents Francis J. Kaas and Lorri M. Kaas or on behalf of said Respondents to settle this matter $22.970 of the settlement proceeds shall be paid to said Respondents. and U.S. Bank, National Association N.D.; $76 of the proceeds shall be paid to Washington Mutual Bank.
