Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION 08-07- <br />RESOLUTION DECLARING THE WESTERLY 416 FEET OF 160`h LANE LYING WITHIN <br />THE NW'/4 OF SWl/ OF SECTION 15, TOWNSHIP 32, RANGE 25 AS A MINIMUM <br />MAINTENANCE STREET <br />WHEREAS, the City acquired by eminent domain for public street purposes a 66 foot right-of- <br />way described as the westerly 416 feet of 160`h Lane lying within Section 15, Township 32, Range 25 (the <br />"Subject Roadway"); and <br />WHEREAS, Minn. Stat.§160.095 permits the City to designate certain city streets as Minimum <br />Maintenance streets upon certain findings; and <br />WHEREAS, the City Council finds that that Subject Roadway is only occasionally or <br />intermittently used by members of the general public because: <br />(1) it serves as the primary access for one residential parcel only; <br />(2) it serves as an alternate access for the accessory buildings of one other adj acent parcel; and <br />(3) it terminates at the residential parcel and provides no through access for members of the <br />traveling public; and <br />WHEREAS, the point of beginning of the Subject Roadway is 1,350 feet west of its intersection <br />with Jasper Street NW and its end point is 1,766 feet west thereof; and <br />WHEREAS, the City Council finds it necessary to establish construction standards for the <br />Subject Roadway; and <br />WHEREAS, the City Council finds it necessary to establish the future maintenance standards for <br />the Subject Roadway. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Subject Roadway is designated Minimum-Maintenance Road. <br />2. That the Subject Roadway be constructed to the following standards: <br />a) The 66 foot right-of--way shall be cleared of trees/growth 18 feet on each side of <br />..centerline; <br />b) Stumps shall be grubbed and the roadway graded to a width of 36 feet; <br />c) A 20 foot wide four inch lift of Class. V shall be installed in the center of the 36 foot wide <br />cleared area ("Base Area"); and <br />d) A 12 foot wide lift of bituminous pavement shall be installed centered within the Base <br />Area. <br />-120- <br />
