Kaaa and Lorri M. Kans. (eolleetivcly "Kaas"). and the City oC Itnmscy,. a Minnesota <br />municipal corporation (the "City"). <br />WHEREAS, The City has commenced an eminent domain proceeding against the <br />property of Kass, ct.al. for the purpose of acyuiring a permanent ea.;;ement fot^ right of way far <br />roadway purposes. and the parties have agreed to a settlement which settles all issues outstanding. <br />between them. ' <br />NOW, TEIEREFORE, in consideration of the mutual covenants contained in this <br />Agreement: <br />1. Payment for Damaeea. The City shall pay a total sum at'$36;:lOO.OO~to Respondents <br />Francis J. Kaas and Lorci M.
