Goodrich, City Attorney <br />Background: <br />The Charter Commission has been meeting over the past several months to consider amendments <br />and to draft amendment language to Charter Sections 2.5 and 4.5.5 <br />e 12 2008 meeting the Charter Commission recommended that the City Council enact an <br />At its Jun , <br />ordinance to amend the Charter as above stated. <br />cr__ <br />The Section 2.5 proposed amendment changes the procedure for announcing an elec~CU ~ili~~ <br />anc and adds a provision for a sitting coulcilmember to act as a liaison for the constituents <br />vac y <br />whose elected office is vacated. <br />The Section 4.5.5 proposed amendment changes the procedure for ~ ele cion that then ~al ~e <br />vacancy occurs at a time so close to either the primary or gener <br />re uirements cannot be met. These amendments are requiren o ~~l~nasy systemdSection 4.5.5 <br />q <br />primary election system in the City. At the time of adoptio p <br />was not amended to reflect the necessary changes. <br />'s antici ated that Charter Commission Chairperson Hannah LaMere will be present at the public <br />It i p <br />hearing to speak on behalf of the proposed ordinance. A draft of the ordinance recommended is <br />also enclosed. <br />The procedure for amending the ordinance is prescribed by State Statute which is as follows: <br />(1) The Charter Commission recommends the ~e ~~o~~ to change the Charter <br />Council. The City Council does not hav <br />Commission's recommendation. <br />2 Prior to final ordinance enactment, the Council must hold a public hearing upon two <br />O week's published notice. <br />(3) -The ordinance requires the affirmative vote of all Councilmembers to be adopted. <br />(4) The ordinance is not effective unti190 days after passage and publication. <br />(5) Within 60 days after passage and publication of the ordinance, a petition requesting <br />a referendum on the ordinance can be filed wi filmin City Clerk.
