<br />Motion carried. <br /> <br />Case #2: <br /> <br />Adopt Ordinance Amending Section 9.11.04 (Accessory Structures) of the <br />Zoning Chapter of City Code <br /> <br />Community Development Director Miller stated that these amendments reflect two housekeeping <br />items and one policy change. She stated that the policy change is that accessory structures that <br />are 125 sq. ft. or less will now be included in the overall total square footage allowed. She stated <br />that the public hearing was held on June 5, 2008. <br /> <br />Motion by Councilmember Jeffrey, seconded by Councilmember Elvig, to adopt Ordinance #08- <br />18 to amend Section 9.11.04 (Accessory Structures) ofthe Ramsey City code. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Look Aye <br />Councilmember Elvig Aye <br />Councilmember Strommen Aye <br />Councilmember Olson Aye <br />Councilmember Dehen Aye <br />Councilmember Jeffrey Aye <br />Mayor Gamec Aye <br /> <br />Motion carried. <br /> <br />Case #3: <br /> <br />Consider Proposed Amendments to Section 5.08 (public Nuisances) of <br />Chapter 5 of City Code; Case of City of Ramsey <br /> <br />Community Development Director Miller stated staff is recommending some language changes <br />to make this section of the code easier to understand. She read aloud the existing definition of <br />"inoperable vehicle" and the proposed revised definition. The revised definition would read: <br />Inoperable Vehicle: Any motor vehicle which cannot meet all of the following criteria: 1) The <br />vehicle must be able to be driven or propelled under its own power upon demand in its existing <br />condition; and 2) The vehicle must be able to be driven or propelled under its own power in a <br />safe manner (not be wrecked, junked, or dismantled at the time of inspections and/or abatement); <br />and 3) The vehicle must have current license plates and tabs; and 4) The vehicle must have <br />current proof of liability insurance, as required by State Law. <br /> <br />Councilmember Dehen asked if the City can lawfully enter private property and request <br />somebody move their vehicle. <br /> <br />City Attorney Goodrich stated that the City cannot lawfully enter private property and do this. <br />He stated that item 1 of the revised language poses difficulty in prosecution and noted that at <br />least one judge has ruled that you cannot force a defendant to incriminate him or herself.
