<br />Case #5: <br /> <br />Consider Policy for Construction use of Sidewalks in Ramsey Town Center <br /> <br />Civil Engineer II Linton stated that the streets cape in Ramsey Town Center is about 90% <br />completed. He noted that the trash receptacles and benches should be here by the end of the <br />month. He stated that this policy was presented at the Public Works meeting on June 17,2008. <br />He stated that basically this policy states that if a developer damages the sidewalk, they are <br />responsible for correcting the problem. <br /> <br />Councilmember Elvig stated that the Public Works Committee discussed having this policy City <br />wide and not just in the Ramsey Town Center. <br /> <br />Councilmember Dehen asked the City Attorney if it would be better to have this policy in the <br />development agreement, have a separate ordinance, or have it in both places. <br /> <br />City Attorney Goodrich stated that including it in the development agreement makes it a <br />contractual obligation of the respective parties, but it could be put into the ordinance, which is <br />basically the City's law and all parties would have to comply. He stated that putting it into the <br />ordinance is the more secure vehicle to establish a policy. <br /> <br />Councilmember Elvig stated that the Public Works Committee discussion was that this should be <br />included in every development agreement as a way of making this a little "tighter" so everyone <br />understands the Council "means it". <br /> <br />Councilmember Dehen stated that if this is considered outside of the Ramsey Town Center, for <br />example someone building a house, there is not a development agreement. <br /> <br />Councilmember Elvig stated that this is why he thinks this should come back for further <br />discussion by the Council outside of the Ramsey Town Center. He suggested that the Council <br />adopt the policy for the whole City and not just for the Ramsey Town Center. <br /> <br />Councilmember Strommen stated that the case being presented tonight is for Ramsey Town <br />Center. She suggested that the Council adopt this policy for the Ramsey Town Center and have <br />staff prepare language for an overall sidewalk guideline for the rest of the City. <br /> <br />Councilmember Look noted that the planters in the streetscape in Ramsey Town Center have <br />flowers in them and look really nice. He asked if maintaining these flowers was included in the <br />development agreement. He also asked what would happen if a developer decided they didn't <br />like the flowers in the planters and wanted to change them. <br /> <br />Civil Engineer II Linton stated that the planters are in the City's right of way, so the City will be <br />responsible for them. <br /> <br />Councilmember Elvig stated that there may also be some involvement from the local garden <br />clubs and other private groups that may take on the planters as a project. <br /> <br />City Council / July 8, 2008 <br />Page 7 of 12 <br />
