<br />BOARD OF COUNTY COMMISSIONERS <br />Anoka County, Minnesota <br /> <br />DATE: August 26, 2008 <br />OFFERED BY COMMISSIONER: Berg <br /> <br />RESOLUTioN #2008-94 <br /> <br />RESOLUTION DESIGNATING PART OF RIGHT-OF-WAY <br />FOR CSAH NO.5 AS BICYCLE PATH <br /> <br />WHEREAS, Minn. Stat. ~ 160.263, subd. 2, provides in part that the "governing body of any <br />political subdivision may by ordinance or resolution. . . develop and designate bicycle paths. . ."; and, , <br /> <br />WHEREAS, the county right-of-way for CSAH No.5 (Nowthen Blvd.) from Trunk Highway <br />No. 47 to Alpine Drive C"Nowthen Blvd. Corridor") is an area of high pedestrian and bicycle Iraffle <br />because of its close proximity to Ramsey Elementary School; and, <br /> <br />WHEREAS, the City of Ramsey ("City") would like to construct a bicycle path within county <br />highway right-of-way through the Nowthen Blvd. Corridor; and, <br /> <br />WHEREAS. it would be in the best interest of the county to designate a portion of the right-of- <br />way through the Nowthen Blvd. Corridor as a bicycle path to facilitate the City's cons,lrUction of a <br />bicycle path: <br /> <br />NOW, THEREFORE, BE IT RESOLVED that pursuant to Minn. Stat. ~ 160.263, subd. 2,the <br />Anoka County Board of Commissioners hereby designates the northeasterly 20 ft. of county highway <br />right-of-way forCSAH No.5 within the Nowthen Blvd. Corridor as a bicycle path. <br /> <br />BE IT FURTIlER RESOLVED that this resolution shall not become effective until such time as <br />the county and City enter into a joint powers agreement defining each ,partie.s' responsibilities with <br />regards to construction and maintenance of the bicycle' path, and the City indemillfying the county <br />against any claims associated with the placement. construction, and maintenance of the bike path. <br /> <br />STATE OF MINNESOTA) <br />COUNTY OF ANOKA ) 55 <br /> <br />1, Terry 1..
