<br />JOINT POWERS AGREEMENT <br />BETWEEN ANOKA COUNTY AND THE CITY OF RAMSEY <br />DESIGNATING A PART OF THE RIGHT-OF-WAY <br />FOR CSAH NO.5 AS BICYCLE PATH <br /> <br />This Agreement is made and entered into this _ day of , 2008, by and <br />between the County of Anoka, a political subdivision of the State of Minnesota, 2100 3rd Avenue <br />North, Anoka, Minnesota 55303, hereinafter referred to as the "County," and the City of <br />Ramsey, 7550 Sunwood Drive NW, Ramsey, Minnesota 55303, hereinafter referred to as the <br />"City". <br /> <br />WITNESSETH <br /> <br />WHEREAS, Minn. Stat. S 160.263, subd. 2, provides in part that the governing body of <br />any political subdivision may by ordinance or resolution develop and designate bicycle paths; <br />and <br /> <br />WHEREAS, the county right-of-way for CSAH No.5 (Nowthen Blvd.) from Trunk <br />Highway No. 47 to Alpine Drive (''Nowthen Blvd. Corridor") is an area of high pedestrian and <br />bicycle traffic because of its close proximity to Ramsey Elementary School; and <br /> <br />WHEREAS, the City would like to construct a bicycle path and or trail within county <br />highway right-of-way through the Nowthen Blvd. Corridor (the "Bicycle Path"); and <br /> <br />WHEREAS, it would be in the best interest ofthe County to designate a portion of the <br />right-of-way through the Nowthen Blvd. Corridor as a bicycle path to permit the City's <br />construction of a bicycle path in order to aid the safety of pedestrian and bicycle traffic in the <br />general area; and <br /> <br />WHEREAS, the City agrees to be responsible for all costs of construction and <br />maintenance of the Bicycle Path; and <br /> <br />WHEREAS, Minn. Stat. S 471.59 authorizes political subdivisions of the State to enter <br />into joint power agreements for the joint exercise of power common to each; <br /> <br />NOW, THEREFORE, it is mutually stipulated and agreed to as follows: <br /> <br />1. PURPOSE <br />The parties have joined together to protect the safety of pedestrians and bicyclists by the <br />County permitting the City to construct and maintain a bicycle path/trail within the <br />Nowthen Corridor as provided hereinafter. <br /> <br />2. USE OF COUNTY HIGHWAY RIGHT OF WAY <br />Pursuant to Minn. Stat. S 160.263, subd. 2, the County grants a permit to the City to <br />construct and maintain the Bicycle Path within the northeasterly 20 feet of County <br />highway Right-of-way for CSAH No.5 within the Nowthen Blvd. Corridor. <br /> <br />1 <br /> <br />-129- <br />
