<br />Void <br /> <br />Board Member Cleveland introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #07-04-088 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME <br /> <br />WHEREAS, George and Denise Swanson ("Permittees") have properly applied for a <br />variance from minimum street frontage or lot width requirements in order to construct a dwelling <br />on the property legally described as follows: <br /> <br />That part of the east 300 feet of the Northeast Quarter of the Northeast Quarter of <br />Section 6, Township 32, Range 25 lying south of the north 363 feet thereof, subject to <br />easement of record, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />WHEREAS, the Board of Adjustment met on April 5, 2007, conducted the public <br />hearing and adopted findings of fact. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based on Findings of Fact #0793, a variance from minimum street frontage or lot width <br />requirements to construct a dwelling on the Subject Property is hereby granted contingent <br />upon the Permittees providing the City with the following: <br /> <br />a. Written confirmation of access resolution with Anoka County Highway Department as it <br />relates to the proposed access and any modifications to the Permittee's current access <br />onto County Road #64; and <br /> <br />b. Verification that a private easement has been recorded at Anoka County property <br />records granting access from the Subject Property to County Road No. 64 (181 st <br />Avenue N.W.). <br /> <br />2. This variance shall automatically expire if it is not initiated within 12 months of the date of <br />issuance of an access permit from the Anoka County Highway Department. Application for a <br />building permit shall constitute initiation. The Permittees may petition for an extension of <br />time in which to complete the variance. Such extension shall be requested in writing and <br />filed with the City at least 30 days before the expiration of the original variance. <br /> <br />3. The Subject Property is eligible for building permits for one dwelling unit and related <br />accessory structures in accordance with City Code and no further building permits for <br />additional residential structures will be issued until such time as the Subject Property is <br />replatted in accordance with City Code and access is provided via a public road improved to <br />City standards. <br />
