<br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #08-09-_ <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A REQUEST <br />FROM LYNETTE AND DAVID RANDALL FOR A CONDITIONAL USE PERMIT FOR <br />A PRIVATE DOG KENNEL TO MAINTAIN FOUR OR MORE DOGS ON A PARCEL <br />OF PROPERTY. <br /> <br />WHEREAS, the City of Ramsey received an application from Lynette and David Randall <br />for a conditional use permit to maintain more than three dogs on the property generally known as <br />7960 171st Lane NW, and legally described as follows: . <br /> <br />Lot 3, Block 1, Dellwood Hills, of Anoka County, Minnesota <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY TillS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the fmdings of fact relating <br />to the request are determined to be as follows: <br /> <br />L That CityCode Section 5.03.09 allows a maXimum of three dogs per parcel. <br /> <br />2. That on May 29, 2008, Lynette and David Randall, hereinafter referred to as "Applicants", <br />properly applied for a conditional use permit for a private dog kennel to maintain four or <br />more dogs on the Subject Property. <br /> <br />3. That the applicants appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on July 10,2008, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. . <br /> <br />4. That the Subject Property is zoned R-l Rural Developing. <br /> <br />5. That the adjacent properties are also zoned R-l Rural Developing. <br /> <br />6. That th~ Subject Property is approximately 2.27 acres in size. <br /> <br />7. That Section 5.09.03 of the Ramsey City Code defines private dog kennels as any place <br />where four or more dogs over six (6) months of age on property occupied by the dog owner <br />. for residential purposes and where the keeping of such dogs in incidental to the occupancy of <br />the premises, and may include breeding and .selling dogs as a hobby. . <br /> <br />8. That private kennels are a conditional use per City Code Section 9.20.11. <br /> <br />9. That the Applicants are proposing to maintain five (5) dogs on the Subj~ct Property <br />including one lab/Dalmatian mix, one Shih Tzu, one Terrier, and two Dachshunds. <br /> <br />-206- <br />
