<br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION NO. 08-09- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT #_ AND DECLARING TERMS OF PERMIT FOR <br />PRIVATE DOG KENNEL TO MAINTAIN A MAXIMUM OF FIVE DOGS ON A <br />PARCEL OF LAND AT .7960 171 ST LANE NW. <br /> <br />WHEREAS, the Ramsey City Council adopted Resolution No. 08-09-_ adopting <br />Findings of Fact #_ for this use and herein approves the Conditional Use Permit subject to the <br />following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY TIm CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKACOUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On September 23, 2008, a Conditional UsePermit ("Permit") was issued by the City of Ramsey <br />("City") to Lynette and David Randall ("Permittee") for a private dog kennel to maintain a <br />maximum of five dogs on the property generally known as 7960 171 st Lane NW and legally <br />described as follows: <br /> <br />Lot 3, Block 1, Dellwo04 Hills, of Anoka County, Minnesota. <br /> <br />("Subject Property"). <br /> <br />This Permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of <br />this Permit are as follows: <br /> <br />1. This Permit shall remain in effect so long as the conditions imposed herein are complied <br />with. <br /> <br />. 2. This Permit shall allow for the maintenance of a maximum of five (5) dogs on the Subject <br />Property over six (6) months of age. <br /> <br />3. Upon confirmation of any complaints of odor or noise problems relating to the dogs, the <br />City may take action to abate the nuisance in accordance with Section 5.09.03 (Dog <br />Regulations), subd. 18 (Dogs Disturbing the Peace), of the Ramsey City Code, attached <br />hereto as Exhibit A. <br /> <br />.4. That the Subject Property shall be maintained in a sanitary condition according to State and <br />local humane standards. <br /> <br />5. That no dog under the ownership of the Permittee shall be allowed torun at large, and at all <br />times the dogs shall be physically controlled by either a. permanent or temporary <br />confinement area or on a leash. <br /> <br />-208- <br />
