Councilmember introduced the following resolution and moved for its adoption: RESOLUTION NO. 08-09- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT #_ AND DECLARING TERMS OF PERMIT FOR PRIVATE DOG KENNEL TO MAINTAIN A MAXIMUM OF FIVE DOGS ON A PARCEL OF LAND AT .7960 171 ST LANE NW. WHEREAS, the Ramsey City Council adopted Resolution No. 08-09-_ adopting Findings of Fact #_ for this use and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY TIm CITY COUNCIL OF THE CITY OF RAMSEY, ANOKACOUNTY, STATE OF MINNESOTA, as follows: On September 23, 2008, a Conditional UsePermit ("Permit") was issued by the City of Ramsey ("City") to Lynette and David Randall ("Permittee") for a private dog kennel to maintain a maximum of five dogs on the property generally known as 7960 171 st Lane NW and legally described as follows: Lot 3, Block 1, Dellwo04 Hills, of Anoka County, Minnesota. ("Subject Property"). This Permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this Permit are as follows: 1. This Permit shall remain in effect so long as the conditions imposed herein are complied with. . 2. This Permit shall allow for the maintenance of a maximum of five (5) dogs on the Subject Property over six (6) months of age. 3. Upon confirmation of any complaints of odor or noise problems relating to the dogs, the City may take action to abate the nuisance in accordance with Section 5.09.03 (Dog Regulations), subd. 18 (Dogs Disturbing the Peace), of the Ramsey City Code, attached hereto as Exhibit A. .4. That the Subject Property shall be maintained in a sanitary condition according to State and local humane standards. 5. That no dog under the ownership of the Permittee shall be allowed torun at large, and at all times the dogs shall be physically controlled by either a. permanent or temporary confinement area or on a leash. -208-
