<br />A bituminous trail will be required to be constructed along 161 st Avenue within the boundaries <br />Lot 1, Block 1. A continuance of that trail will also be required from the westerly boundary of <br />Lot 1 to the common boundary with Central Park to complete the pedestrian connection with <br />Central Park. This segment of trail is considered temporary in nature because it lies within <br />outlots that may be further developed in the future. Also, construction of a hard surface trail may <br />unnecessarily impact trees at this point in time. - For these reasons, the temporary portion of the <br />trail is approved for construction with a natural-material, such as mulch~ <br /> <br />Also, it is the City's policy to require trail construction on both sides of MSA roads, and <br />Variolite Street is an MSA road. However, due to the relative distance and cost associated with <br />that portion of - trail on Variolite Street, staff would be comfortable simply requiring a trail <br />easement until more use would be gained from trail construction. The Development Agreement <br />for the Plat will require the easements for the trails on 161 st and on Variolite in separate, <br />recordable documents as trails cannot be dedicated on plats. <br /> <br />Park dedication is also due for Lot 1 of the plat; park dedication for outlots are satisfied when <br />they are platted for development. The City desires land adjacent to Central Park to satisfy park <br />dedication requirements. The Applicant also desires to satisfy park dedication requirements for <br />the entire plat at this time. The church is considered a commercial use arid the land dedication is <br />equal to 5% of the gross land area, or in this case 1.85 acres. The Applicants are proposing to <br />deed Outlot A to the City which is 2 acres in size. In the event Outlot B is developed with a <br />residential use at some point in the future, the commercial rate used at this time will have to be - <br />reconciled with the density of residential units to be developed. <br /> <br />Funding: <br /> <br />The Applicants are responsible for all City costs incurred in processing the minor subdivision. <br /> <br />Recommendation: <br /> <br />The Planning Commission and City Staff recommend final plat approval. <br /> <br />Council Action: <br /> <br />Motion by Councilmember and seconded by Councilmember to adopt <br />Resolution #08-09-_ granting final plat approval to Saint Katharine Drexel Catholic ChUrch <br />contingent upon compiiance with City Staff Review Letter dated September 18, and the <br />applicants entering into a development agreement with the City. <br /> <br />Review Checklist: '1./ <br />/- <br />City Administrator t~ <br />Engineer II <br />Environmental Coordinator <br /> <br /> <br />Copies To: <br />Community Development Director <br />City Attorney <br /> <br />- CC: 09.23.08 <br /> <br />--232- <br />
