g. Installation of irrigation system in accordance with the approved plan prepared by Station Nineteen Architects, Inc., dated , revision dated ,2008. h. Irrigation metering and backflow devices shall be approved as part of the Utility Plan, and installed accordingly. 1. Irrigation rain sensors shall be installed and appropriately placed throughout the development. ("Required Improvements"). 5. FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of these items on the Site shall be as directed by the City's Fire Chief. 6. LIGHTING. Lighting shall be installed on the site in accordance with City Code and the submitted lighting plan prepared by and dated ,2008. 7. BUILDING FACADE. The Permittee agrees to construct all building faces of the same material as listed on the Building Elevations prepared by Station Nineteen Architects, Inc. dated August 11, 2008. 8. REQUIREMENTS FOR BUILDING PERMIT. No building permit for the Site will be issued until the Permittee has: a) signed and returned this Development Permit, b) provided the City with the required financial sureties and fees and fulfilled all obligations associated with this Development Permitand the Development Agreement for the final plat of-Saint Katharine Drexel Catholic Church; and c) recorded the Plat at Anoka County. No Certificate of Occupancy for the structure will.be issued until the Required Improvements, or a finanCial surety for same, are accepted by the City. 9. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements shall be completed before October 1,2009. 10. RECOGNITION OF LOCATION. The Permittee herein agrees to recognize Ramsey as the City oflocation on all forms of advertising and business correspondence whenever reasonably prudent to do so. 11. STORMWATER MANAGEMENT FEE. The CITY has enacted a Stormwater Management Fee in the amount of Four Thousand Two Hundred Thirty Eight Dollars and no , cents ($4,238.00) per commercial acre; The amount of Stormwater Management Fee due on the Site is Nineteen Thousand Seventy One Dollars and no cents ($19,071.00). A cash payment will be required prior to the CITY releasing the Building Permit. 12. FINANCIAL SURETY. In order to ensure the installation of the Required Improvements in accordance with City specifications and in a timely manner, the Permittee shall be required to deposit with the City a cash escrow or letter of credit, approved as to form by the City, in the amount of Eight Hundred Thirty Eight Thousand Dollars and no cents ($838,000.00), which is 150% of the City's estimated cost of the Required Improvements. Prior to the issuance of the building permit, all financial guarantees must be provided as required herein. -279-
