Absent: Councilmember Elvig. <br /> <br />The public hearing was closed at 8:00 p.m. <br /> <br />Council Business <br /> <br />Mayor Gamec called the regular City Council meeting back to order at 8:00 p.m. <br /> <br />Motion by Councilmember Olson, seconded by Councilmember Jeffrey, to adopt <br />Resolution #08-09-185 through #08-09-189 adopting assessments for Improvement <br />Projects #08-05 and #08-07. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Olson, Jeffrey, Dehen, <br />Look, and Strommen. Voting No: None. Absent: Councilmember Elvig. <br /> <br />Case #3: <br /> <br />Consider Resolution in Support of Ramsey Residents in Regard to <br />PACT Charter School Enrollment Preference <br /> <br />Mayor Gamec noted that he did not want to debate this issue tonight because there had <br />been a discussion at the work session on September 8,2008. <br /> <br />Dan DeBruyn, 9000 168th Ave NW, stated that he is the Administrator of the PACT <br />school and, first of all, wanted to thank to staff for having the 3rd and 4th graders over <br />here. He stated that he also appreciates being given time to address this issue and noted <br />that this originally came before the Council in April, when a decision was postponed until <br />a district court decision was made. He stated that he is here tonight to ask the Council to <br />vote no on the resolution. <br /> <br />Councilmember Jeffrey stated that he has thought long and hard about this issue and he <br />made the original motion to table until a district court decision came down. He stated <br />that he feels he needs to apologize that this motion keeps getting tied to a court case <br />because he thinks it is inappropriate. <br /> <br />Motion by Councilmember Jeffrey, seconded by Councilmember Strommen to deny the <br />Resolution in Support of Ramsey Residents in Regard to PACT Charter School <br />Enrollment Preference. <br /> <br />Further Discussion: Councilmember Look read aloud a portion of the resolution and <br />noted that the district court decision was not a decision but was dismissed on procedure <br />and not based on merit. He stated that the case is at the appellate court and will hopefully <br />be decided on merit. He asked what Mr. DeBruyn's plan B is, if the appellate court <br />reverses this decision. He stated that his point is that Mr. DeBruyn doesn't know yet so <br />there is no rush on this resolution. He stated that the Council is elected to represent <br />people of Ramsey and at the same Council Work Session had talked about the local <br /> <br />City Council / September' 23, 2008 <br />Page 11 of21 <br />
