He stated that the <br />City is not out looking for problems. <br /> <br />Mr. Vlasyuk stated that he has all his stuff in his yard and Police Chief Way says it is <br />fine, but he is worried that someone else will come and tell him it isn't again. <br /> <br />Mayor Gamec stated that Mr. Vlasyuk should deal with Police Chief Way and if he says <br />it is okay, then it is fine. <br /> <br />Mr. Vlasyuk stated that Police Chief Way said it is out of his hands and it is for the City <br />to decide. <br /> <br />Mayor Gamec stated that the bill will stand because there was a violation of ordinance at <br />the time and the Council cannot change that. <br /> <br />Mr. Vlasyuk asked if they could come again and take it away and charge him again. <br /> <br />Mayor Gamec stated that if he is in violation again, they can and suggested that he talk <br />with Police Chief Way about this issue. <br /> <br />City Attorney Goodrich stated that three of the residents have talked about the abatement <br />process, which is a civil process, to clean up properties that have outside storage or junk <br />items. He stated that he would like to make it clear that the City is not summarily doing <br />these things but has given notice to the individuals concerned. He stated that if there is <br />an appeal it goes before a hearing examiner and each individual involved has the right <br />and due process to question whether or not the City has the right to do this. He stated that <br />in Mr. Vlasyuk's situation, no appeal was made, so the City lawfully entered the property <br />and abated the nuisance. <br /> <br />Mayor Gamec reiterated the City is enforcing the ordinance but the action is started by a <br />complaint from neighbors. <br /> <br />There were no further comments. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Jeffrey to close the <br />public hearing. <br /> <br />Further Discussion: Councilmember Jeffrey asked if the City would look into these <br />comments and get back to people on the process. City Attorney Goodrich stated that the <br />abatements have been completed, and the appeal periods have expired, but he can explain <br />the process of what happened to those involved. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Jeffrey, Dehen, <br />Look, Olson, and Strommen.
