<br />Commissioner Cleveland stated it only takes one dog bite and the applicants would be liable. <br /> <br />Commissioner VanScoy requested clarification regarding the definition of a kennel. <br /> <br />Assistant Community Development Director Frolik stated the Code differentiates between a <br />private and commercial kennel; a private kennel is intended for personal enjoyment versus a <br />commercial kennel which is intended as a business. - <br /> <br />Commissioner VanScoy asked if there are requirements for containment <br /> <br />. Assistant Community Development Director Frolik replied the Planning Commission can <br />consider adding terms to the Conditional Use Permit that would require a fenced-in area or play <br />area for the animals. <br /> <br />Associate Planner Gladhill added the. CUP terms would not have to require that the entire 2.5 <br />acres be fenced in. <br /> <br />Mrs. Dowling stated on one occasion, she witnessed somebody riding on a bicycle with two <br />children and the applicant's dogs were barking and chasing after the bicyclist She stated they <br />have discussed the issue of putting up a fence with Mr. Randall and he indicated it would not be <br />a problem financially for them. <br /> <br />Mr. Dowling stated all he asks is that the applicants keep their dogs out of his yard and to leave <br />him alone. <br /> <br />Motion by Commissioner VanScoy, secol;lded by Commissioner Rogers, to close the public <br />hearing. <br /> <br />Motion Carried. Absent: Chairperson Nixt <br /> <br />The public h~aring closed at 7:29 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 7:29 <br />p.m. <br /> <br />Commissioner VanScoy stated if someone has five dogs, they ought to have a place where they <br />can run and be contained. He felt a condition should be. added to the.
