PAUL PUBLIC FACILITIES POLICY (Revisions4/3/89, 12/11/89,4/23/90, 8/27/90, 1 tl12/91, 9/28/92, 11/22/93, 119/95, 4/10/95, 81\4/95, 11/12/96, 12116/96,10/27/97,7/27/98,8/13/01,5/13/02, 6/23/03, 7/28/03, 8/8/0S) It is the policy of the City of West St. Paul to provide quality streets for the use of nil taxpayers. Streets not meeting minimllll'l quality standards by reason of nge or damage will be schedtlled for resurfacing or replacllment (as needed) on an area basis, Within the area or areas designated by COLlI1cil for a given two year period, all streets needing work will be done, unless the majority of owners on a particulnr block tiles written objection with the City Clerk at or before the public hearing regarding the improvement. An ~mnual street maintenance assessment will be levied on all blocks which so decline the resurfacing/replacement progranl, in order to meet the extraordinary maintenance costs incurred to patch those streets, It shall be City policy to subsidize the resurfacing/replacement program, so that owners shall be assessed a fixed amount per front foot. This amount shall be: $36.70 per front foot for 2006 and later reconstruction work; $12.20 per front foot for 2006 and later mill und overlay work; suid amounts to be adjusted by inflation in the future. No subsidy work will be done without stich assessment. Assessments will run with terms up to tell (10) years to allow easier repayrnent. Cornel' Lot Cl'edit: The Total Assessable Footage (T AF) for a cornel' lot with both sides abutting work under this program shall be the total length of street fnmtage minus the lesser of the length of the longest side or 100 feet, Any allowable credit will not be applied until such time that the second side is considQred tor assessment, A similar ct'edlt maybe applied to odd-shaped and/or double.frontage lots at the Council's discretion, excem that dO~lble",tl'ontage residential lots Llsing, Qrpotentially Llsing, the rear street for garage access will be assessed at one- half the ClIl'rent street reconstruction rate for the rear lot width with no other credit ul.\owed. All streets receiving City subsidy money must have, 01' must have installed, "B" type concrete curb and gutter, Nothing in the foregoing policy shall prevent property owners from petitioning fOl'work bringing their streets to minimum quality standards at their own expense, either outside the areas being currently done, or within those areas to standards different from those used in the subsidy program. Although need will be the primary determining factor in setting the order of the work, another important factor will be citizen support of the program, evidenced by petitions, Any proposed project which, after proper notice and hearing is voted on in the negative, in agreement with the views of the majority of the abutting property owners, may not be again considered for the reconstruction wort, until such time that all other segments in need of such work have received due consideration. That underground lawn sprinklers and landscaping features which do not interfere with the public use qfthe street right~ot"'way may be installed and maintained In said right-or-way at the sole risk und expense of the owner of the adjacent property installing or maintaining the same. It is the responsibility of the owner of the adjacent property to promptly remove or move such sprinklers or landscaping features to facilitate the City's repair of reconstruction of its streets or utilities. . The City of West St. Paul shall not be responsible for any damage to or the destruction ot'sprinklers or landscaping teatures within the public street right-of-way in its maintenance, repair or reconstruction ofthe street or any utilities therein, -41-
