Absent: Chairperson Nixt. <br /> <br />Motion by Commissioner Van Scoy, seconded by Commissioner Cleveland, to recommend that <br />City Council grant approval of the Conditional Use Permit based on the amended findings of <br />fact, declaring terms of the same, and amending condition #5 as follows: <br /> <br />5. That no dog under the ownership ofthe Permittee shall be allowed to run at large, <br />and at all times the dogs shall be physically controlled by either a permanent or <br />temporary confinement area or on a leash. <br /> <br />Motion Carried. Absent: Chairperson Nixt. <br /> <br />Ms. Lynette Randall again appeared before the Planning Commission and requested clarification <br />regarding the number of dogs permitted. She asked if the CUP would be in effect if at some <br />point in the future she has only three dogs on the property. <br /> <br />Associate Planner Gladhill replied if she has only three dogs on the property; she can cancel the <br />CUP and the containment restrictions would no longer apply. <br /> <br />Case #2: <br /> <br />Public Hearing - Request for a Conditional Use Permit to Exceed Sign Size <br />Restrictions; Case of PSD, LLC <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 7:52 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearine: <br /> <br />Chairperson Nixt called the public hearing to order at 7:52 p.m. <br /> <br />Presentation <br /> <br />Assistant Community Development Director Frolik stated the City received an application from <br />PSD, LLC requesting a conditional use permit to exceed sign size restrictions for the Ramsey <br />Office Plaza building located at 7533 Sunwood Drive N.W. She indicated the Town Center <br />district sign regulations are much more restrictive than those for the general Business and <br />Employment districts throughout the community and explained that buildings in Town Center are <br />allowed one wall sign per street frontage and the size limit on the sign is 5% of the area of the <br />ground level fayade or 24 square feet, whichever is less. She stated this compares to 15% of the <br />area of the entire building fayade, not just ground level, in the City's other business districts, or <br />25% of the area of the entire building fayade is using channel levels. She indicated the applicant <br />is requesting a conditional use permit to install two more wall signs on the north and south <br /> <br />Planning Commission/September 4, 2008 <br />Page 6 of 12 <br />
