bascd can the submitted site layout, there are more. than enough parking stalls to satisfy this <br />requirement. <br />Staff has reviewed the proposed use and finds that it is compatible with the surrounding area. <br />The majority of activity contemplated by the Applicant and prospective tenant will occur on <br />Sunday momings'(two services, one at 9:00am and the second at 10:30am). There would also be <br />some evening activities a couple days a week that focus on kids and/or youth groups with <br />estimated attendances ranging between 15 and 30 people, Existing tenants in the multi -unit <br />building include a liquor store, which obviously is closed on Sundays, and a pizza delivery <br />business that does not offer dine -in services. Thus, the ,additional activities do not appear to <br />conflict with the existing businesses, <br />Remodeling of the interior of the building will be necessary to accommodate the prospective <br />tenant, which will require the issuance of a building permit(s). Per Section 1306 of the MN State <br />Building Code, the change in occupancy (changing from a class M [Mercantile] to a class A-3 <br />[Assembly]) triggers the need for a fire suppression system (sprinkling). However; Section 1306 <br />also states that the Fire Chief and Building Official, together, may waive the fire suppression <br />requirement if water is not available, The property is not connected to city water. <br />The Applicant initially requested the duration of the Interim Use Permit be five (5) years, which. <br />is the maximum allowable time permitted by City Code. Staff negotiated the term of the permit <br />down to three (3) years. Due to.the temporary nature of the request (3 years), in conjunction with <br />the fact that this property is on a private well rather than city water, both the Fire Chief and <br />Building Official have agreed that the fire suppression requirement maybe waived. <br />It is Staff s opinion that the Interim Use Permit should be granted for a three (3) year term. It is <br />Staff's belief that this would provide Hope Fellowship some flexibility in searching for and <br />securing either property or an existing facility for their permanent "home" while also providing <br />the Applicant the ability to secure another occupant for their multi -tenant building. Upon the <br />expiration of the permit, should the applicant and/or prospective tenant wish to request an <br />extension or reapply for another Interim Use Permit, a full Staff review would again be <br />necessary. <br />The Planning Commission met on October 2, conducted a public hearing and recommended that <br />City Council approve an Interim Use Permit for a term of three (3) years. <br />Recommendation; <br />The Planning Commission and Staff recommend that the Interim Use Permit request by Rum <br />River Retail Ventures to allow for the temporary operation of a church facility in an area zoned <br />B-1 Business District be granted for a term of three (3) years, <br />Funding Source; <br />All costs associated with processing the application are the responsibility of the applicant. <br />—316— <br />
