j, Installation of appropriate traffic control signage. <br />k. Installation of temporary stormwater pond on Lot 7, Block 1, Alpaca Estates 0 Addition <br />("Adjacent Parcel") and recording of temporary drainage and utility easement on Adjacent <br />Parcel. <br />("Required Improvements"). <br />5. FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of these items on <br />the Site shall be as directed by the City's Fire Chief. <br />6. LIGHTING. Lighting shall be installed on the site in accordance with City Code and is subject <br />to the approval of the City Engineer. <br />7. BUILDING FACADE. The Permittee agrees to construct all building faces of the same <br />material as listed on the Building Elevations prepared by C.M. Architecture dated March 3, <br />2008, <br />8. REQUIREMENTS FOR BUILDING PERMIT. No building permit for the Site will be <br />issued until the Permittee has; a) signed and returned this Development Permit, b) the City has <br />received the required financial surety and inspection fees. <br />No Certificate of Occupancy for the structure will be issued until the Required <br />Improvements, or a financial surety for same, are accepted by the City. <br />9. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements shall be <br />completed before November 13, 2009, <br />10. RECOGNITION OF LOCATION. The Permittee herein agrees to recognize Ramsey as the <br />City of location on all forms of advertising and business correspondence whenever reasonably <br />prudent to do so. <br />11. FINANCIAL SURETY. In order to ensure the installation of the Required Improvements in <br />accordance with City specifications and in a timely manner, the Permittee shall be required to <br />deposit with the City a cash escrow or letter of credit, approved as to form by the City, in the <br />amount of Three Hundred Seven Five Hundred Dollars and No Cents ($307,500.00) which is <br />150% of the City's estimated cost of the Required Improvements including landscaping. <br />Prior to the issuance of the building permit, all financial guarantees must be provided as <br />required herein. <br />Upon completion of the construction of the Required Improvements, the financial guarantee <br />shall be returned to. the Permittee and the Permittee shall be required to provide the <br />landscaping maintenance guarantee described in Item #12 of this Development Permit. The <br />determination of completion of the construction of the Required Improvements shall be made <br />by the City Engineer. In the event the Permittee fails to construct and install the Required <br />Improvements as required herein, the City Council may order the completion of the Required <br />Improvements with City day labor and/or by letting contracts for said completion and draw <br />upon the escrow for payment. Only the City Council shall have the authority to direct <br />completion of the Required Improvements and withdraw from the escrow account. The <br />-352- <br />
