CASE <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT <br />TO MAINTAIN A SECOND DWELLING ON A PARCEL <br />CASE OF HANNA SMITH <br /> By: Megan Wald, Community Development Assistant <br /> <br />Background: <br /> <br />City Code states that there shall not be more than one main building on a lot unless otherwise <br />provided for in City Code. In 1989 the owner of 8201 163~a Avenue applied for a building <br />permit to build a home and a detached, 2-story tuck-under garage. During the construction of the <br />tuck-under garage, it became apparent that the property owner was intending to develop the <br />upper level of the detached tuck-under garage as an apartment. Staff informed the owner that <br />City Code prohibits two dwellings on one parcel and a connection between the house and <br />detached structure would be required for the upper level of the garage to be .legal living quarters. <br />The property owner proceeded to construct an underground tunnel between the two (2), structures <br />that Staff determined did not meet the spirit of City Code. Care Senior Services, inc. <br />Proposed Findings of Fact <br />Proposed Conditional Use Permit <br /> <br />I <br />! <br />I <br />I <br />I <br /> <br />Notification: <br /> <br />In accordance with State statute staff sent notification of the public hearing to property owners <br />within 350 feet of the subject property. <br /> <br />Observations: <br /> <br />With respect to the senior foster home itself, State Statute says that an adult foster home is a <br />permitted use tn a residential district. Loving Care Senior Services will be licensed by the <br />County, they are allowed a total of five (5) senior citizens who are 60 years or older. Anoka <br />County will conduct inspections of the adult foster care facility every other year after the first <br />year. The State Marshall will also conduct inspections of the facility in-conjunction with Anoka <br /> <br />-103- <br /> <br /> <br />
