County. State Statute prohibits seniors to be in the adult foster care facility who have a serious <br />and persistent mental illness or developmental disability. <br /> <br />State Law does not require the owner of Loving Care Senior Services to live at the facility, full- <br />time. Hanna Smith will not be living on site, however Loving Care Senior Services provides one <br />on-site Home Health Aid 24-hours a day. The Health Aid shifts are from 7:00am - 3:00pm, <br />3:00pm - l l:00pm, and I l:00pm -7:00am. The facility would also have one full-time on-site <br />nurse who will also serve as the manager of the facility. <br /> <br />The Conditional Use Permit requested is in regards to Loving Care Senior Services desire to <br />utilize a second dwelling on a parcel for a nurses living quarters. Conditional use permits have <br />been issued in the past for more than one dwelling on a residential lot. The Delaney family <br />estate (Armstrong Kennels) has a conditional use permit for 4 dwellings. The Thomaswood <br />Estate (Tom Kurak homestead) was granted a conditional use permit for two dwellings in order <br />that the seller, Mr. Thorn, could live on the property for the rest of his life. Don Kveton received <br />a Conditional Use Permit for two (2) dwellings on his property, his home and a dwelling for his <br />caretakers. <br /> <br />Since the lot has been vacant for so many years vegetation on the parcel consisted of nothing but <br />tall weeds and existing mature trees. Hanna Smith has made several site improvements to the <br />estate since purchasing the property. Staff toured the site and saw a vast improvement to the <br />outside landscaping. The applicant planted 171 various bushes; river rock and keystone block <br />have been strategically designed around the entire main dwelling and a cement pathway with <br />established landscaping on both sides has been constructed to the proposed second dwelling. <br /> <br />The parcel contains many mature trees in the front, side, and rear yard. A sprinkler system has <br />been installed and the entire parcel has been spread with black dirt and seeded. The property now <br />contains two courtyards, one in the front and one in the rear yard, with landscaping established <br />around each courtyard. Staff feels that the applicant has installed a landscaping plan that exceeds <br />City standards. <br /> <br />Staff was able to view the inside of the proposed second dwelling. The interior of the building is' <br />completely sheet rocked and it appears that most of the electrical outlets are in place but not <br />necessarily working. The structure is absent of flooring, a finished kitchen, a finished bathroom, <br />and working plumbing. The current status of the facility is that it is not in a livable condition. If <br />the proposed use is approved, the applicant will' make the necessary improvements to provide for <br />a livable facility. <br /> <br />On September 5, 2000, the Planning Commission reviewed the request for an interim use permit <br />by Loving Care Senior Services to utilize a detached accessory building as a second dwelling. <br />The interim use permit language would have required the' applicant to construct a 50-foot above <br />ground addition connecting the two dwellings within a five-year per/od. The Planning <br />Commission noted that the City has granted Conditional Use Permits in the past to maintain two <br />dwellings on a parcel and wanted to proceed in a similar manner. The Planning Commission <br />tabled the item and directed Staff to draft the request as a Conditional Use Permit and bring the <br />item to the October meeting for their review. The Planning Commission reviewed the <br />Conditional Use Permit application and held a public hearing on October 3, 2000. <br /> <br />-104- <br /> <br /> <br />
