COMPLIANCE WITH LAWS AND REGULATIONS <br /> <br />The DEVELOPER represents to the CITY that the proposed Development complies <br />with all City, County, Metropolitan, State, and Federal laws and regulations, including <br />but not limited to: Subdivision Ordinance, Zoning Ordinances and Environmental <br />Regulations. The DEVELOPER agrees to comply with such laws and regulations. <br /> <br />7. ADDITIONAL CONDITIONS OF APPROVAL <br /> <br />The Development shall also comply with the following conditions: <br /> <br />Co <br /> <br />eo <br /> <br />fo <br /> <br />That on-street parking shall be restricted to one side of the private streets within <br />the Development. Further said, on-street parking regulations shall be signed and <br />siad signing shall be subject to the approval of the CITY. <br />That the barrier to be located just south of Argon Street entering into the Mallard <br />Ponds Development be designed such that it can be easily removed in times of <br />emergencies, and subject to the approval of the CITY. <br />That at no time will the private streets be maintained or accepted for ownership by <br />the City. <br />All items should be clearly stated in the Covenants drafted as apart of the <br />homeowner's association. These Association documents shall include appropriate <br />enforcement provisions and said provisions shall remain in effect throughout the <br />life of the development. <br />The minimum lot sizes for each housing type shall be as follows: detached <br />townhome - 3,900 square feet; twinhome - 3,300 square feet; quadhome - 2,000 <br />square feet. The minimum finished floor area for all units shall be 800 square <br />feet. <br />Outlot A shall be approved for development with commercial uses in accordance <br />with the standards and regulations for the B-1 and B-2 Business districts. <br /> <br />8. STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES <br /> <br />The DEVELOPER intends to cause the construction of the following improvements in <br />the Plat without financial participation on the part of the CITY, to-wit: Sanitary sewer, <br />storm drainage facilities, watermains and appurtenances, streets with concrete curb and <br />gutter, and sidewalks which improvements are termed Stage I Improvements in the City <br />Code ("Stage I Improvements"); and <br /> <br />City Code Section 9.50.50 defines "Stage I" Improvements and "Stage II" Improvements <br />which respective definitions are used herein when reference is made to "Stage I" and <br />"Stage II' Improvements; and the DEVELOPER desires to construct the Stage I and <br />Stage II improvements, except for those Stage II Improvements constructed by the CITY; <br />and, no expenditure of CITY funds will be made until the City Code escrow <br />requirements have been completed by the DEVELOPER. <br /> <br />-239- <br /> <br /> <br />
