Proposed Covenants <br /> <br />Substantial departures from the approved plans will require and amendment to the <br />Planned Unit Development, site plan and/or Final Plat in accordance with Section 9.20.31 <br />(Planned Unit Development) Subd. 4 (Major chnages) of the Ramsey City Code. Failure <br />by the DEVELOPER to commence development activity, within one year following the <br />f'mal plat approval of this Planned Unit Development, will necessitate the approval of an <br />extension of the development schedule by the City Council. <br /> <br />3. RIGHT TO PROCEED <br /> <br />Within the PUD, the DEVELOPER may not grade or otherwise disturb the earth, <br />remove trees, construct sewer lines, water lines, streets, utilities, public or private <br />improvements, or any buildings until all the following conditions have been satisfied: (a) <br />this Agreement has been fully executed by both parties and filed with the City <br />Administrator, and (b) the City has issued a letter that all conditions required to <br />commence the improvements have been satisfied and that the DEVELOPER may <br />proceed. <br /> <br />4. APPROVAL OF CONTRACTOR <br /> <br />Any Contractor(s) selected by the DEVELOPER to construct and install any <br />DEVELOPER installed improvement must be determined by the CITY to be acceptable <br />and approved in writing. <br /> <br />5.
