7. LIGHTING. Any lighting installed on the Site is subject to pr/or approval by the City <br /> Engineer. <br /> <br />BUILDING FACADE. The Permittee agrees to construct the Structures of maintenance- <br />free siding, windows and asphalt shingles in accordance with the Building Elevations <br />prepared by Pam McCullum's Drafting Service. <br /> <br />REQUIREMENTS FOR BUILDING PERIYHT. No building permits for the Site will be <br />issued until the Permittee has: a) signed and returned this Development Permit and the <br />Planned Unit Development Subdivision Agreement; b) all financial obligations of the <br />Planned Unit Development Subdivision Agreement have been fulfilled; c) the plat of <br />Mallard ponds has been recorded at Anoka County. <br /> <br />10. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements shall <br /> be completed before June 1,2001. <br /> <br />11. ESCROW FOR REQUIRED IMPROVEMENTS. The standard surety insuring the <br /> installation of the Required Improvements shall be provided as a part of the Stage I surety <br /> required in the Planned Unit Development Subdivision Agreement. <br /> <br />12. MAINTENANCE GUARANTEE FOR LANDSCAPING. It is herein agreed that the <br /> Developer shall provide a maintenance guarantee to ensure the survival of the plantings on <br /> Blocks 2 and 3. Said maintenance guarantee shall consist of cash or a Letter of Credit, <br /> approved as to form by the City, in the amount of Four Thousand Eight Hundred Dollars and <br /> No Cents ($5,000.00). <br /> <br />At the end of the two year period, the maintenance guarantee shall be returned to the <br />Developer. The determination that all plantings that have been planted in accordance with <br />the Site Plan have either survived or have been replaced shall be made by the City Engineer. <br />In the event the Permirtee fails to maintain the required plantings for a two-year period, the <br />City Council may order the replacement of plantings with City day labor and/or by letting <br />contracts and draw upon the escrow for payment. Only the City Council shall have the <br />authority to direct replacement of the plantings and withdraw from the escrow account. The <br />Permit'tee hereby grants permission and a license to the City and/or its contractors and <br />assigns to enter upon the Site for the purpose of replacing plantings in the event of the <br />Permittee's default. <br /> <br />13. RECOGNITION OF LOCATION.
