7. LIGHTING. Any lighting installed on the Site is subject to pr/or approval by the City Engineer. BUILDING FACADE. The Permittee agrees to construct the Structures of maintenance- free siding, windows and asphalt shingles in accordance with the Building Elevations prepared by Pam McCullum's Drafting Service. REQUIREMENTS FOR BUILDING PERIYHT. No building permits for the Site will be issued until the Permittee has: a) signed and returned this Development Permit and the Planned Unit Development Subdivision Agreement; b) all financial obligations of the Planned Unit Development Subdivision Agreement have been fulfilled; c) the plat of Mallard ponds has been recorded at Anoka County. 10. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements shall be completed before June 1,2001. 11. ESCROW FOR REQUIRED IMPROVEMENTS. The standard surety insuring the installation of the Required Improvements shall be provided as a part of the Stage I surety required in the Planned Unit Development Subdivision Agreement. 12. MAINTENANCE GUARANTEE FOR LANDSCAPING. It is herein agreed that the Developer shall provide a maintenance guarantee to ensure the survival of the plantings on Blocks 2 and 3. Said maintenance guarantee shall consist of cash or a Letter of Credit, approved as to form by the City, in the amount of Four Thousand Eight Hundred Dollars and No Cents ($5,000.00). At the end of the two year period, the maintenance guarantee shall be returned to the Developer. The determination that all plantings that have been planted in accordance with the Site Plan have either survived or have been replaced shall be made by the City Engineer. In the event the Permirtee fails to maintain the required plantings for a two-year period, the City Council may order the replacement of plantings with City day labor and/or by letting contracts and draw upon the escrow for payment. Only the City Council shall have the authority to direct replacement of the plantings and withdraw from the escrow account. The Permit'tee hereby grants permission and a license to the City and/or its contractors and assigns to enter upon the Site for the purpose of replacing plantings in the event of the Permittee's default. 13. RECOGNITION OF LOCATION. The Permittee herein agrees to recognize Ramsey as the City of location for the development on all forms of advertising and business correspondence. Bulow, Inc., hereby acknowledge receipt of tiffs Permit and that they have reviewed the conditions of this permit and have agreed that they will comply with the terms of this Permit.
