Commissioner Dempsey replied that he would first approach the Chairperson of the Planning <br />Commission and then the Council. <br /> <br />Mr. Hudson pointed out that each Councilmember may have varying opinions. <br /> <br />Mayor Gamec stated that he prefers not to give the Commission his idea, but rather a direction. <br /> <br />Commissioner Johnson felt it would be helpful to go through staff and then if the Council is <br />unhappy with the way the information is being delivered to the Commission then they would be <br />able to approach staff. If the communication is scattered then it becomes impossible to <br />discipline. <br /> <br />Commissioner Dempsey suggested that if the Commission is unable to have legal representation <br />at their meetings, then the materials should be given to the City Attorney for comment prior to <br />the meeting. He also noted that there have been a number of instances where there is rush to get <br />materials to the Commission and than a great deal of information is missing from the case. <br /> <br />Mr. Hudson questioned how the problem could be solved. <br /> <br />Commissioner Jensen replied that the City could become tougher on the applicants. If the <br />information is not complete then it should not be presented to the Commission. <br /> <br />Councilmember Hendriksen stated that there were many incidences where City Attorney <br />Goodrich was present at Planning Commission meetings when they were discussing <br />controversial items. <br /> <br />Commissioner Dempsy replied that since he has been on the Planning Commission the City <br />Attorney has never been present in an official capacity. <br /> <br />Councilmember Zimmerman suggested that the Chairperson work with the City Administrator <br />on resolving the Commissions legal concerns. <br /> <br />Mr. Hudson reviewed the suggestions that were addressed during the meeting that included: <br />picking-up the phone, having joint-meetings, clarifying goals, using legal council, accept the fact <br />that it is not going to be perfect, and if clarification is needed from Council, use staff. <br /> <br />Commissioner Johnson stated that the Commission has been addressing the Mallard Ponds <br />development and explained that the resident's main objection was due to the traffic concerns, not <br />the density. There remains a significant traffic issue in the area, which is outside the <br />Commission's authority and requested that the Council consider the problems the City has with <br />Dysprosium. <br /> <br />ADJOURNMENT <br /> <br />City Council/March 20, 2000 <br /> Page 5 of 5 <br /> <br /> -35- <br /> <br /> <br />
