<br />.. <br /> <br />7. Thatthe Permittee agrees that the terms of this variance shall be binding upon its successors <br />.'. and assigns. <br /> <br />8. That this variance shall automatically expire if the use is not initiated by July 10,2009, and <br />issuance of the building permit shall constitute initiation. The Permittee may petition for an <br />extension of time in which to complete the variance. Such extension shall be requested in <br />writing and filed with the City at least 30 days before the expiration of the original variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Cleveland, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Van Scoy <br />Board Member Levine <br />Board Member Cleveland <br />Board Member Hunt <br />Board Member Rogers <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />Board Member Brauer <br /> <br />and the following were absent: <br /> <br />Board Member Nixt <br /> <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this <br />the 10th day of July, 2008. <br /> <br />RESOLUTION #08-07-119 <br />Page 2 of3 <br />
