<br />CASE #6 <br /> <br />ADOPTION OF ORDINANCE FOR THE VACATION OF A PORTION OF <br />THE GARNET STREET NWRIGHT-OF-WAY, SOUTH OF 150TH AVENuE NW <br />By: Tim Himmer, Assistant City Engineer <br /> <br />Background: <br /> <br />On May 13,2008 City Council authorized City project 08-29, Alpine Park Watermain Loop and ordered staff to <br />prepare plans and specifications forthe construction. This approval also including acquisition of Lot 2, Block 6 <br />PELTZER ADDITION from the Minnesota Pollution Control Agency (MPCA), construction of a trail <br />connection to Alpine Park, and limited parking facilities for the approved skate park expansion within the park. <br /> <br />On August 12, 2008 City Council authorized the advertisement for bid. Prior to receiving the bids further <br />discussions were had wifh the MPCA on the property and easement acquisitions necessary for the project. The <br />timing to complete the required documents and acquisition/easements has extended the scheduling of the project <br />as the MPCA has stated that they will not allow access onto their property until the required agreements are in <br />place. They also requested plan revisions to lessen the impact to their property, and address their concern for <br />potential gas migration. <br /> <br />In working through a redesign staff contacted the existing property owners that currently gain access from the <br />Garnet Street cul-de-sac. There are currently 2 driveways south of 150th Avenue NW. The property at 14910 <br />Garnet Street NW will be relocating their driveway to 148th Lane NW in conjunction with the project. The <br />homeowner at 6830 150th Avenue NW has worked with staff and agreed to relocate their second driveway as <br />part of a planned addition to their existing home. <br /> <br />Vacating a portion of the right-of-way provides enough usable land for the homeowner at 6830 150th Avenue <br />NW to proceed with their planned improvements and relocation of driveway. It allows the entire cul-de-sac, <br />south of 150th Avenue, to be removed and/or replaced with a bituminous trail. The City will still retain a 50' <br />right-of-way to utilize as a roadway corridor if we should ever choose to connect the existing neighborhoods in <br />the future. <br /> <br />Notices were mailed to the adjacent property owners, and the information was appropriately published in the <br />newspaper.
